Common use of Payment for Working Overtime Clause in Contracts

Payment for Working Overtime. a) All work done outside ordinary hours, will have overtime penalty rates paid at double time b) With the exception of the provisions of clause 13.8 (c) in computing overtime each day’s work shall stand alone. c) An Employee who performs call-in or fault/emergency response work and who commences work on overtime rates prior to 5am, shall remain on overtime rates until the completion of their work. For example, if an employee commences work at 3am & finishes at 9am, they shall be paid overtime rates until he/she returns to their place of residence. d) If an employee who performs call-in or fault/emergency response work and commences on overtime rates after 5am, the employee will be paid at overtime rates until the usual commencement time. In this case, at the employee’s usual commencement time, the ordinary hourly rate will apply. This is providing that prior to the commencement of the overtime, the employee has had a ten-hour break in accordance with clause 13.8 & 13.9.
