Payment to Engineer. Monthly invoices will be issued by Engineer for all work performed under this Agreement. Invoices are due and payable on receipt. Interest at the rate of 1-1/2 percent per month, or that permitted by law if lesser, will be charged on all past-due amounts starting 30 days after date of invoice. Payments will first be credited to interest and then to principal. In the event of a disputed or contested billing, only that portion so contested will be withheld from payment, and the undisputed portion will be paid. The Owner will exercise reasonableness in contesting any xxxx or portion thereof. No interest will accrue on any contested portion of the billing until mutually resolved.
Payment to Engineer for the services established under this Work Authorization shall be made in accordance with the Agreement.
Payment to Engineer. 2.1 CITY shall pay ENGINEER the following compensation for the Basic Services provided pursuant to Section 1 of this Agreement: (Refer to Exhibit D for Specified Salary Rates and Exhibit D-1 for Detailed Engineering Fees) a. OTHER: Reimbursable Expenses CITY shall not be responsible for payment to ENGINEER for any additional services not included in Exhibit A & B, except upon execution of an amendment to this Agreement in writing by both parties. CITY shall provide all criteria and full information as to CITY'S requirements for the project; designate a person to act with authority on CITY's behalf in respect of all aspects of the Project; examine and respond promptly to ENGINEER's submissions; and give prompt written notice to ENGINEER whenever CITY observes or otherwise becomes aware of any defect in the work. 3.2. CITY shall advise ENGINEER in writing of all budgetary limitations for Total Project Costs and Total Construction Costs. ENGINEER shall submit to CITY at each submittal and as requested by the CITY the ENGINEER’s opinions as to the probability of completing construction within CITY’s budget. ENGINEER shall inform City of applicable adjustments in the budget and revisions in the extent or quality of the Project. 3.3 CITY shall, guarantee access to and make all provisions for ENGINEER to enter upon public and private property. ENGINEER shall inform the CITY in advance before entering into provide property. 3.4 If applicable, CITY shall designate a party to have responsibility and authority for coordinating the activities of the various prime contractors, if more than one prime contractor is to be awarded for construction. 3.5 C...
Payment to Engineer. Engineer shall submit statements to Town for services rendered and for reimbursable expenses incurred. City shall make prompt payment in response to Engineer’s statements.
Payment to Engineer. The total amount of compensation for all phases of the Project is Thirty Thousand Six Hundred Fifty-two and no/100 DOLLARS ($30,652.00 ). The Engineer’s fee proposal for the performance of all Basic Services and reimbursable expenses for the Project (Section 3.2) is attached hereto as Attachment "B".
