Permanent Teacher Due Process Rights. 13.5.1 The permanent teacher shall be entitled to review all reports generated by the peer coach prior to their submission to the Panel and to have affixed thereto their comments. To effectuate this right, the peer coach shall provide the permanent teacher being reviewed with copies of such reports at least five (5) working days prior to any such meeting. 13.5.2 The permanent teacher shall have a right to be represented by MDEA in any meetings of the Panel to which they are called and shall be given a reasonable opportunity to present their point of view concerning any report being made. 13.5.3 The decision to refer a permanent teacher for intervention through this PAR Program shall not be subject to the grievance procedure. 13.5.4 The permanent teacher shall have the right to timely reports of progress being made. 13.5.5 The permanent teacher shall have the right to present reasons why a specific peer coach should be replaced and another coach substituted and to have those reasons considered.

To effectuate this right, the Peer Coach shall provide the permanent teacher being reviewed with copies of such reports at least five (5) working days prior to the meeting of the PAR Panel at which the reports will be considered. 39.5.2 The permanent teacher shall have the right to be represented by UESF in any meetings of the Panel to which s/he is called and shall be given a reasonable opportunity to present his/her point of view concerning any report being made. 39.5.3 The decision to refer a permanent teacher for intervention through this Program shall not be subject to the grievance process, nor shall a decision to remove a permanent teacher from the Program be grievable. 39.5.4 The permanent teacher shall have the right to timely reports of progress being made. 39.5.5 The permanent teacher shall have the right to present reasons in writing to the PAR Panel why a specific Peer Coach should be replaced and another Peer Coach substituted and to have those reasons considered. 39.5.6 The record of this intervention may be sealed within the personnel file after four (4) years, if there have been no subsequent incidents of unsatisfactory service during said period. 39.5.7 This Program in no manner diminishes the legal rights of bargaining unit members of the District.

The permanent teacher shall have the right to be represented by Menifee Teachers’ Association in any meetings of the PAR Panel to which he/she is called and shall be given a reasonable opportunity to present his/her point of view concerning any report generated.
Permanent Teacher Due Process Rights. 13.4.1 A participating teacher is a unit member who receives assistance and coaching to improve instructional skills and classroom management. Unit members who receive a composite unsatisfactory will be required to participate in the PAR program as an intervention. 13.4.2 The participating teacher has the right to meet with the PAR council to choose between a minimum of two available consulting teachers. 13.4.3 The participating teacher shall be entitled to review all reports generated by the consulting teacher prior to their submission to the panel and to have his/her comments affixed. The consulting teacher will provide the permanent teacher being 13.4.4 The permanent teacher shall have a right to be represented in any meetings of the panel to which they are called. They shall be given a reasonable opportunity to present his or her point of view concerning any report being made. 13.4.5 The permanent teacher shall have the right to timely progress reports.

  • Termination Due To Lack Of Funding Appropriation If, in the judgment of the Director of Accounts and Reports, Department of Administration, sufficient funds are not appropriated to continue the function performed in this agreement and for the payment of the charges hereunder, State may terminate this agreement at the end of its current fiscal year. State agrees to give written notice of termination to contractor at least 30 days prior to the end of its current fiscal year, and shall give such notice for a greater period prior to the end of such fiscal year as may be provided in this contract, except that such notice shall not be required prior to 90 days before the end of such fiscal year.   • Obligations of Business Associate Upon Termination Upon termination of this Agreement for any reason, business associate shall return to covered entity or, if agreed to by covered entity, destroy all protected health information received from covered entity, or created, maintained, or received by business associate on behalf of covered entity, that the business associate still maintains in any form. Business associate shall retain no copies of the protected health information.

  • Termination of Therapy Therapist reserves the right to terminate therapy at his/her discretion. Reasons for termination include, but are not limited to, untimely payment of fees, failure to comply with treatment recommendations, conflicts of interest, failure to participate in therapy, Patient needs are outside of Therapist’s scope of competence or practice, or Patient is not making adequate progress in therapy. Patient has the right to terminate therapy at his/her discretion. Upon either party’s decision to terminate therapy, Therapist will generally recommend that Patient participate in at least one, or possibly more, termination sessions. These sessions are intended to facilitate a positive termination experience and give both parties an opportunity to reflect on the work that has been done. Therapist will also attempt to ensure a smooth transition to another therapist by offering referrals to Patient.
