Physical Architectures. 4.3.1 Level 3 shall have the sole right and discretion to specify any of the following three methods for interconnection at any of the BA-IPs:
(a) a physical or virtual Collocation node Xxxxx 0 xxxxxxxxxxx xx xxx XX-XX; xxx/xx
(x) a physical or virtual Collocation node established separately at the BA-IP by a third party with whom Level 3 has contracted for such purposes; and/or
(c) an Entrance Facility and transport (where applicable) leased from BA (and any necessary multiplexing), to the BA-IP.
4.3.2 Level 3 shall provide its own facilities or purchase necessary transport for the delivery of traffic to any Collocation arrangement it establishes at a BA-IP pursuant to Section 13.
4.3.3 Level 3 may order from BA any of the Interconnection methods specified above in accordance with the rates, order intervals, and other terms and conditions in the Agreement, in any applicable Tariff(s), or as may be subsequently agreed to between the Parties. Under each of the options specified above, Level 3 shall interconnect with BA at a DS1 or DS3 level; provided, however, that upon mutual agreement of the Parties higher speed connections (e.g., optical connections) may be made, when and where available.
4.3.4 BA shall have the sole right and discretion to specify any of the following methods for Interconnection at any of the Level 3-IPs:
(a) a physical or virtual Collocation node BA establishes at the Level 3-IP; and/or
(b) a physical or virtual Collocation node established separately at the Level 3-IP by a third party with whom BA has contracted for such purposes; and/or
(c) an Entrance Facility leased from Level 3 (and any necessary multiplexing), to the Level 3-IP.
4.3.5 BA shall provide its own facilities or purchase necessary transport for the delivery of traffic to any Collocation node it establishes at a Level 3-IP pursuant to Section 13.
4.3.6 BA may order from Level 3 any of the Interconnection methods specified above in accordance with the order intervals and other terms and conditions, including, without limitation, rates and charges, set forth in this Agreement, in any applicable Tariff(s), or as may be subsequently agreed to between the Parties. Physical Architectures. 4.2.1 In each LATA identified in Schedule 4.0, the Parties shall utilize the Covad-IP(s) and BA-IP(s) designated in such Schedule as the points from which each Party will provide the transport and termination of traffic.
4.2.2 Covad shall have the sole right and discretion to specify any of the following methods for interconnection at any of the BA-IPs:
(a) a Physical or Virtual Collocation facility Covad establishes at the BA-IP;
(b) a Physical or Virtual Collocation facility established separately at the BA-IP by a third party with whom Covad has contracted for such purposes; and/or
(c) an entrance facility and transport (where applicable) leased from BA (and any necessary multiplexing), where such facility extends to the BA-IP from a mutually agreed to point on Covad's network.
4.2.3 Covad shall provide its own facilities or purchase necessary transport for the delivery of traffic to any Collocation arrangement it establishes at a BA-IP pursuant to Section 13. BA shall provide the transport and termination of the traffic beyond the BA-IP.
4.2.4 Covad may order from BA any of the Interconnection methods specified above in accordance with the order intervals and other terms and conditions, including, without limitation, rates and charges, set forth in this Agreement, in any applicable Tariff(s), or as may be subsequently agreed to between the Parties.
4.2.5 BA shall have the sole right and discretion to specify any one of the following methods for Interconnection at any of the Covad-IPs:
(a) upon reasonable notice to Covad, a Physical Collocation facility BA establishes at the Covad-IP;
(b) a Physical or Virtual Collocation facility established separately at the Covad-IP by a third party with whom BA has contracted for such purposes; and/or
(c) an entrance facility leased from Covad (and any necessary multiplexing), where such facility extends to the Covad-IP from a mutually agreed upon point on BA's network.
4.2.6 BA shall provide its own facilities or purchase necessary transport for the delivery of traffic to any Collocation arrangement it establishes at an Covad-IP pursuant to Section 13. Covad shall provide the transport and termination of the traffic beyond the Covad-IP.

(c) an entrance facility and transport (where applicable) leased from BA (and any necessary multiplexing), where such facility extends to the BA-IP from a mutually agreed to point on ETC’s network.
4.2.3 ETC shall provide its own facilities or purchase necessary transport for the delivery of traffic to any Collocation arrangement it establishes at a BA-IP pursuant to Section
Physical Architectures. 4.2.1 In each LATA where direct Interconnection is used, the Parties shall utilize the POI(s) designated as the points from which the Parties will provide the transport and termination of traffic. Each Party is operationally and financially responsible for bringing its facilities (and the originating traffic over those facilities) to the POI(s).
4.2.2 The Parties may mutually agree to any of the following methods for direct Interconnection:
(a) a Physical Collocation facility established separately by a Party or by a third party with whom Cox or Pac-West has contracted for such purposes;
(b) an entrance facility and transport (and any necessary multiplexing) provided by or leased from a Party or a third party, pursuant to its effective Tariff;
(c) a Mid-Span Meet, pursuant to Section 4.3;

Physical Architectures. 4.3.1 MFN shall have the sole right and discretion to specify any of the following three methods for interconnection at any of the BA-IPs: a physical or virtual Collocation node MFN established at the BA-IP; and/or
Physical Architectures. 4.3.1 AT&T Broadband shall have the sole right and discretion to specify any of the following methods for interconnection at any of the Verizon-IPs:
(a) a physical or virtual Collocation node AT&T Broadband established at the Verizon-IP; and/or
(b) a physical or virtual Collocation node established separately at the Verizon-IP by a third party with whom AT&T Broadband has contracted for such purposes; and/or
(c) an entrance facility and transport (where applicable) leased from Verizon (and any necessary multiplexing) to the Verizon-IP, at the rates specified in Exhibit A; and/or
(d) a Mid-Span Fiber Meet arrangement as described in Section 4.4.
4.3.2 AT&T Broadband shall provide its own facilities or purchase necessary transport for the delivery of traffic to any Collocation arrangement it establishes at a Verizon-IP pursuant to Section 13.
4.3.3 AT&T Broadband may order from Verizon any of the Interconnection methods specified above in accordance with the rates, order intervals and other terms and conditions, in the Agreement, in any applicable Tariff(s), or as may be subsequently agreed to between the Parties.
4.3.4 Verizon shall have the right to interconnection at any of the AT&T Broadband-IPs through
(a) an entrance facility and transport (where applicable) leased from AT&T Broadband (and any necessary multiplexing), to the AT&T Broadband-IP at the rates specified in Exhibit A; and/or
(b) a Mid-Span Fiber Meet arrangement established at AT&T Broadband’s request pursuant to section 4.3.1; and/or
(c) provisioning its own transport facilities to a AT&T Broadband-IP. If Verizon chooses to provision its own transport facilities (either to a new AT&T Broadband-IP or to augment transport facilities to an existing AT&T Broadband-IP), Verizon will pay AT&T Broadband such rates as approved by the Department for terminating Verizon’s transport facilities at the AT&T Broadband-IP which rates shall be consistent with Applicable Law (“Self Provisioning Rates”); provided, however, the Parties acknowledge that, as of the Effective Date, the Department has not approved, nor has AT&T Broadband submitted to the Department for approval, any Self Provisioning Rates.
