Policyholder Service. Except as limited by a new or modified conservation or liquidation order by the Conservation Court, GOLDEN STATE shall handle requests for address, name and policyholder changes, including beneficiary changes, coverage changes, and assignment changes; GOLDEN STATE shall provide policyholders appropriate and proper responses to questions, requests, and complaints of policyholders; GOLDEN STATE shall cancel or otherwise terminate coverage under the Policies and Contracts as required by applicable standards and consistent with applicable regulatory requirements, provided IA AMERICAN shall always retain the right, within the scope of the Policies and Contracts, Industry Standards, and applicable law, upon notice, to direct the termination of Policies and Contracts by itself or by GOLDEN STATE or to terminate Policies and Contracts by direct notice to holders of Policies and Contracts; GOLDEN STATE shall reinstate Policies and Contracts as required by the terms thereof and in accordance with Industry Standards; GOLDEN STATE shall process policy loan requests and implement automatic policy loans, other non-forfeiture options and settlement options; and GOLDEN STATE will provide a toll-free telephone number for policyholder use. To the extent required by applicable state law, GOLDEN STATE agrees to provide a written notice to the insured or policyholder of the Polices, as mutually agreed upon by GOLDEN STATE and IA AMERICAN, advising the insured or policyholder of the identity of the relationship among GOLDEN STATE, the insured or policyholder and the IA AMERICAN. GOLDEN STATE agrees that any policies, certificates, booklets, privacy notices, termination notices or other written communications delivered by IA AMERICAN to GOLDEN STATE for delivery to IA AMERICAN's policyholders shall be delivered by GOLDEN STATE promptly upon receipt of instructions from IA AMERICAN to do so. Costs of such deliveries shall be borne by IA AMERICAN.
Policyholder Service. 5.1 When providing services to Empire Life policyholders, Broker and Empire Life agree as follows:
(a) Broker will be primarily responsible for the servicing of its clients who become Empire Life policyholders. Xxxxxx acknowledges that Empire Life is legally obligated to send statements, invoices and other notices directly to it policyholders;
(b) As permitted by law, Empire Life will provide normal policyholder records and information to Broker in order to enable Broker to service its Empire Life clients;
(c) Broker will exercise the care, skill and diligence that can reasonably be expected for a life insurance Broker.
(d) In the event of the termination of the Agreement or in the event that the policyholder submits notice terminating Broker as registered servicer of the policyholder’s Empire Life policies, Empire Life reserves the right to assign or make other arrangements for servicing of any policy written under this Agreement. As permitted by law, Empire Life will consult with Xxxxxx’s General Agent in the event a policyholder submits such notice of termination and before making alternative servicing arrangements; and
(e) Empire Life will continue to pay renewal commissions to Broker in relation to a policy provided:
(i) the policy remains in force; and
(ii) Xxxxxx’s right to receive compensation in respect of the policy has not been terminated in accordance with the Termination of Commissions section below or otherwise assigned by Broker to another person or entity; and
(iii) renewal commissions or renewal service fess are payable in relation to the policy; and
(iv) payment is not otherwise excluded by then in force Agreement Schedules, and published rules and procedures.
Policyholder Service. FBL shall maintain policyholder records and provide service necessary and appropriate to maintain the insurance in force.
Policyholder Service. Subject to the risks being accepted by the INSURANCE CO. or the underwriters retained by INSURANCE CO., MMB shall issue and endorse policies, and, if so instructed in writing by INSURANCE CO., terminate or cancel policies and issue notices of cancellation. MMB shall bill, xxceive and render receipts for premiums due to INSURANCE CO. in accordance with the terms and conditions of each policy of insurance issued and in accordance with the written instructions of INSURANCE CO. MMB shall have full authority hereunder to take whatever action it deems necessary or appropriate to attempt to collect premiums, including, if so instructed by INSURANCE CO., the 3 cancellation of policies. MMB shall have no liability for uncollected premiums.
Policyholder Service. Subject to the risks being accepted by NEWSOURCE or the underwriters retained by NEWSOURCE, MARSH IAS shall issue and endorse policies, and, if so instructed in writing by NEWSOURCE, terminate or cancel policies and issue notices of cancellation. MARSH IAS shall xxxx, receive and render receipts for premiums due to NEWSOURCE in accordance with the terms and conditions of each policy of insurance issued and in accordance with the written instructions of NEWSOURCE. MARSH IAS shall have full authority hereunder to take whatever action, at NEWSOURCE’s cost and expense, it deems necessary or appropriate to attempt to collect premiums, including, if so instructed by NEWSOURCE, the cancellation of policies. MARSH IAS shall have no liability for uncollected premiums.
Policyholder Service. Guggenheim Life, when requested by Clear Spring Life, shall provide policyholder services including but not limited to the services set forth in Appendix A.
Policyholder Service. Sun Life Canada, when requested by Sun Life NY, shall provide policyholder services including but not limited to activities involving personal contact or communication with a policyholder or beneficiary, activities relating to policy loan applications and payments, surrender requests including computation of benefits payable, policy conversions, beneficiary changes, policy changes, requests for general information, preparation and mailing of disbursements, preparation and mailing of periodic reports and statements, dividend computations, premium payments, policy lapses, expires, nonforfeitures, reinstatements, consumer complaints and other related policyholder services. In addition, when requested by Sun Life NY, Sun Life Canada shall provide advice on unique or complex policyholder services issues with respect to insurance and annuity products transacted by Sun Life NY.
Policyholder Service. G1001 Resources, when requested by GLAC, shall provide policyholder services including, but not limited to, activities involving personal contact or communication with a policyholder or beneficiary, activities relating to policy loan applications and payments, surrender requests including computation of benefits payable, policy conversions, beneficiary changes, policy changes, requests for general information, preparation and mailing of disbursements, preparation and mailing of periodic reports and statements, dividend computations, premium payments, policy lapses, expires, nonforfeitures, reinstatements, consumer complaints and other related policyholder services. In addition, when requested by GLAC, G1001 Resources shall provide advice on unique or complex policyholder services issues with respect to insurance and annuity products transacted by GLAC.
Policyholder Service. Allstate, when requested by ILIC, shall provide policyholder services including but not limited to activities involving personal contact or communication with a policyholder or beneficiary, activities relating to policy loan applications and payments, surrender requests including computation of benefits payable, policy conversions, beneficiary changes, policy changes, requests for general information, preparation and mailing of disbursements, preparation and mailing of periodic reports and statements, dividend computations, premium payments, policy lapses, expires, nonforfeitures, reinstatements, consumer complaints and other related policyholder services. In addition, when requested by ILIC, Allstate shall provide advice on unique or complex policyholder services issues with respect to insurance products transacted by ILIC.
Policyholder Service. Beginning on the Closing Date and continuing -------------------- thereafter, the Reinsurer shall be solely responsible to policyowners, beneficiaries, regulatory authorities, as between the Reinsurer and the Ceding Company and the Ceding Company's affiliates, parent, officers and directors, with respect to the Policies reinsured hereunder, their administration, terms and conditions. Notwithstanding the preceding, beginning on the Closing Date and continuing thereafter, the Reinsurer shall retain the Ceding Company as its servicing and administration agent. However, such retention shall not relieve the Reinsurer of the ultimate responsibility with respect to the servicing and administration of the Policies reinsured hereunder following such assumption. Prior to the Closing Date, the Ceding Company shall be solely responsible to policyowners, beneficiaries, regulatory authorities, as between the Reinsurer and the Ceding Company and the Ceding Company's affiliates, parent, officers and directors, with respect to the Policies reinsured hereunder, their administration, terms and conditions.
