20.2 If an employee receives a new position which is higher in band and/or grade, the employee’s experience and education will be considered for step placement. Placement will be made in relation to comparable positions at the college as required by Oregon Equal Pay Act to determine the appropriate step. Upward classification changes will result in at least a 3.5% increase over current step placement. The employee may negotiate with the College for a higher step placement if appropriate.
20.3 Ten (10) and eleven (11) month Employees will be given first consideration for filling limited- term (see 20.7) or part-time assignment who wish hourly positions during breaks in their work schedule that exceed three weeks providing they meet the minimum qualifications. To be considered for such positions, these employees must make prior application in a separate pool containing only applications from such employees, as no other notice will be provided. The College retains the right to return to fullchoose from among qualified applicants, and such limited- term or part-time assignment hourly positions shall not be combined to extend the regular appointment of any employee. Employees hired for such positions will be paid at the rate of the vacant position and will not accrue vacation leave and will not be paid for holidays. Less than 12-month employees who are hired back during the summer break to perform substantially all of the same responsibilities in the same position shall be assigned to an available vacant fullpaid their regular rate for such work or at the part-time position for which they are certified and qualified based on seniorityhourly rate, whichever is higher.

Position Openings. Public Acts 10021.1 All bargaining unit positions will first open to bargaining unit RIF’d employees in accordance with Section 26. If there are no eligible RIF’d employees, then the positions will be open to all permanent bargaining unit members for a minimum period of five (5) days. The position will be posted using email to all College Campus locations. The College may also advertise externally during this time. An employee interested in an advertised position must apply in accordance with the application instructions to the HR Department within the published deadline.
21.2 HR shall screen for minimum qualifications and determine who will be interviewed.
21.3 The screening committee will select the best applicants, participate in the interviews, and shall make recommendations to the President/designee for final consideration for the position. A screening committee will consist of: The appropriate supervisor of the area or designee. An administrative representative, as appropriate. A representative appointed by the Association. An additional PTE member selected by the supervisor that is from the department or has relevant expertise. A representative of the Human Resources Department.
21.4 Non-103 successful employee finalists shall be notified, in writing, on the same day as the successful employee finalist. This notification shall provide rationale for the hiring decision and recommendations for developing skills or competencies. The employee may request a face to face meeting with the SA of 2011 HR to discuss the circumstances of the hiring decision and/or to provide additional documentation for further consideration. Any grievances regarding the selection must be made in writing within a five (5) day grace period following said notification. The successful applicant will not be placed in the new assignment until the five (5) day grace period has elapsed. If a grievance is filed, the successful applicant’s current position shall not be permanently filled until mutually agreed to by the Association and the College.
21.5 In the event of only one qualified internal applicant responding to a job posted by the College, the College may make certain portions of this Article null and voiduse the normal interview process or may directly hire
21.6 If the College requires that an employee interview for an advertised vacant position during the employee’s work day, the employee shall not be required to use earned compensatory time or leave without pay, or receive a deduction in salary for time missed or any other applicable contractual benefits.
21.7 If a position is vacated by a probationary employee within the first 60 days on the job, HR may consult the RIF pool for potential candidates. In the event it that no employee in the RIF pool meets the minimum qualifications for the vacated position, HR may proceed directly to the external candidate pool.
21.8 The College will notify the Association prior to the elimination of any bargaining unit position. - CCL
21.9 Hire Temporary Hourly employees in positions that are temporarily vacant, unless the skill level requires internal expertise and then duties may be reassigned or an employee may be temporarily reassigned.
21.10 The College may approve in-training appointments for employees under the following conditions:
21.10.1 The College has recruited internally and there were no qualified applicants.
21.10.2 The supervisor of the vacant position agrees to consider an in- training opportunity in lieu of external recruitment.
21.10.3 Candidates must apply for a position that is judged that advertised as an in training, opportunity using the College’s normal application process, which may also include additional requirements. A supplemental process may be required. Although the in-training position may be filled at any portion(s) of this Article is in conflict with Public Acts 100-103 of 2011level, the conflicting portion(semployee is expected to be able to demonstrate during the interview process their initiative and potential to excel at the higher level.
21.10.4 Candidates must also agree to complete an appropriate Professional Development Plan (PDP) that will enable them to meet the minimum qualifications for the position within a reasonable period of time, to be determined by the supervisor. The PDP may include, but is not limited to, additional education, training, certification(s), or on-the-job experience and training required to continue in the position. The SA of HR shall approve all PDPs.
21.10.5 The employee accepting an in-training appointment will be subject appointed to the lawnew position at their current level and salary for a minimum of six (6) months. Employees will subsequently promote on the salary scale, in accordance with the approved plan.
A. Vacancy shall 21.10.6 Each phase of the in-training period must be defined as a newly created position or a successfully completed. The employee will be evaluated on their progress during each phase, using the approved evaluation form. The failure of the employee to complete any phase of the in-training plan will result in his/her removal from the position, and may include termination. Should this occur, the affected employee may apply for other open positions in the College for which they qualify.
21.10.7 An employee may voluntarily revert to their former position within the school district presently unfilled and for which there is not an association member with a contractual right to return.

A supervisor may also involuntarily revert an employee within the first six (6) months of an in- training assignment. In the event that either situation occurs, the supervisor may recruit externally to fill the vacancy. If the supervisor decides the employee has successfully completed their probationary period of six (6) months then the employee will be posted in the teacher lounges and other suitable places and a copy will be given to the association presidenthired permanently into that position with appropriate pay raise, if applicable.

The applicable Local President will be given written notification and rationale of the “extenuating circumstances”. Position openings will be filled as soon as possible, but within thirty (30) work days after the posting period. The applicable Local President will be notified in writing of any reasons for delays. All position openings shall be posted prior to any temporary or permanent transfers. Management initiated transfers within a job classification based on the reasons Board’s operational needs and demands do not constitute position openings requiring position postings. Position openings must only be posted as a result of a vacancy that occurs due to retirement, termination, death, resignation, demotion, lateral transfer, promotion, or the creation of a new position or a current position that is increased by more than one hour per day or an increase of more than two (2) weeks per year unless the position includes forty-six (46) weeks or more.
6.5.1 Any employee qualified for the position shall have the opportunity to apply in writing to Human Resources for the position and shall be given consideration for the position before any outside applicants are considered. The position shall be awarded to the qualified senior employee applicant who meets the posted qualifications as determined by the administration. An employee applicant’s qualifications shall be based on the job description. In rare circumstances, the Board may include additional qualifications on which Civil Service is unable to test. Such additional qualifications shall not be made in an arbitrary or capricious manner. If Civil Service has not or is unable to test these additional qualifications, then the Board retains the discretion to determine whether a particular applicant meets the qualifications. A trial period employee shall have the right to bid on a vacant position, which is in his/her same classification and is an increase in hours. However, such bidding right shall be no guarantee that such trial period employee will receive appointment to that vacant position. In addition, said trial period employee must still complete any time remaining for their trial period. When a position is awarded the appropriate local president will be notified in writing. No employee shall be prevented from receiving a position opening due to failure of a supervisor to release the employee from previously held position. Any employee candidate not receiving the position may request a conference with Human Resources and will be given a written explanation of why he/she was not selectedselected upon request. A copy of all active lists from Civil Service Commission shall be provided at the time the lists are posted by the Commissioner. A copy of said lists shall be forwarded to all Union Presidents. In the event there is no Civil Service list or test, whichever applies, the above language shall apply until such time as the Board requests a test or list. The Board agrees to request will be answered in writing within ten (10that the Civil Service Commission place present employees, who pass a civil service test, on a preferred list for the test(s) school days after the receipt of the request by the administrationwhich they pass.
D. If any teaching or administrative position becomes available during the time that school is not is session, the following policy 6.5.2 Non-bargaining unit job openings shall be followed:
1. Teachers with specific interests posted at a designated area in possible vacancies will notify the superintendent or his/her designee each building and a copy of their interest, in writing, during the last regular week of school and shall include a summer address.
2. Should a vacancy occur, the teachers who have expressed an interest in said position or a similar position, such posting shall be contacted by sent to each local president. Employees on “Preferred or Promotional Lists” have two occasions where they can indicate not being interested in interviewing or refusing an offer of employment to a different classification prior to being removed from the superintendent or his/her designee and notified of the vacancylist.
3. Teachers on voluntary part-time assignment who wish to return to full-time assignment shall be assigned to an available vacant full-time position for which they are certified and qualified based on seniority.
E. Changes in assignments shall be designated as transfers. On days request when school is dismissed early for both students and teachers, all school office personnel shall be permitted to leave no later than one (1) hour after pupil dismissal time without any reduction in writing compensation During July and August, the reasons he/she was not selectedwork day for twelve month school office personnel shall be six (6) hours per day, exclusive of lunch.
4. The request Substitute caller stipend per the current contracts shall increase be $32 (thirty two dollars) per day. This caller will be answered in writing within ten (10) school days after the receipt of the request appointed by the administrationdistrict, hopefully on a volunteer basis This person shall be one individual and the same individual for the entire school year This employee shall be paid the daily rate for only the days the said person is available to perform the task. In the event a substitute is needed for the appointed person, the substitute shall be paid the daily rate for any days the substitute performs the task. In no case shall the Board pay out any more than the daily rate for any given day.
