Positions outside the Bargaining Unit. (a) In the event that an employee transfers out of the bargaining unit for a specific term or task which does not exceed a period of three (3) months, or an academic year, and is returned to a position in the bargaining unit, seniority and service shall continue to accrue for the period of the transfer. (b) An employee who transfers to a position outside of the bargaining unit for a period exceeding three (3) months and up to twelve (12) months, shall retain, but not accumulate, her seniority held at the time of the transfer. In the event the employee returns to a position in the bargaining unit she shall be credited with the seniority held at the time of transfer and resume accumulation from the date of her return to the bargaining unit. Service shall continue to accumulate during the period of transfer. Should the employee return to the bargaining unit, all other employees shall revert to their previous positions if available. All employees who transfer to positions outside of the bargaining unit for less than one (1) year shall be covered by the collective agreement for the duration of their assignment. If such employees return to the Bargaining Unit, the return shall be to the former Job Classification or a period Job Classification embracing comparable job duties to that which they held prior to appointment, providing such return does not result in excess the lay-off or bumping of one (1) yearan employee holding greater seniority. All employees who transfer to positions outside of the bargaining unit for less than one (1) year shall be covered by the collective agreement Employer for the duration calculation of their assignment. The employee’s wage rate shall be no less than the wages earned in the bargaining unit positionsalary and any monetary benefits.
(c) An employee must remain in the bargaining unit for a period of at least three (3) months before transferring out of the bargaining unit again or she or he will lose all seniority held at the time of the subsequent transfer.
(d) In the event that an employee is transferred to a position outside of the bargaining unit for a period in excess of one (1) year, she or he will lose all seniority held at the time of transfer. In the event the employee is returned to a position in the bargaining unit, the employee’s 's seniority will accrue from the date of her or his return to the bargaining unit.
(d) An employee who transfers to a position outside of the bargaining unit for a period of up to twelve (12) months shall retain but not accumulate bargaining unit seniority while in that position.
(e) In the event that an employee is transferred out of the bargaining unit under (b) above for a period of six (6) months or an academic year and is returned to a position in the bargaining unit, she shall not suffer any loss of seniority, service or benefits. It is understood and agreed that an employee: • may decline an offer to transfer made by the Employer • that the periods period of time referred to above may be extended by agreement of the parties.
(f) The Employer agrees to provide adequate orientation to an employee to fill the role of these positions.

Positions outside the Bargaining Unit.
