13.5 Where there is more than one applicant from the bargaining unit who is qualified for the position, then the employee with the greater seniority shall be awarded the vacancy.
13.6 The Company will carry out any applicable testing that is necessary. The Union will be advised of the passing xxxx xxxxx to testing of bargaining unit employees. An employee will be allowed to have two (2) test failures for each different job classification bid in any twelve (12) month period unless an employee is able to present new evidence of skills, ability or job knowledge, in which case the Company may decide to administer a new test to the employee. The acceptability of the evidence provided shall be at the sole discretion of the Company.
13.7 A bargaining unit employee appointed to a vacancy in accordance with the foregoing shall be subject to a trial period up to forty-five (45) scheduled working days. If within such period the Company determines the employee does not possess the skill, ability, job knowledge and qualifications to perform the work in question, such employee shall be returned to his/her original position vacancy and any employee displaced as a result of such return shall similarly have the right to return to his/her original position.
13.8 During such forty-five (45) scheduled working days period, the employee shall not have seniority rights for the purpose of working overtime, unless there are no other employees available under the established overtime criteria in this agreement.
13.9 Employees successfully qualifying for the bid job will be moved into the new position within 20 calendar days of qualifying unless mutually agreed otherwise between the parties.
13.10 The successful employees shall receive the applicable progression rate of the classification the first day of work in the new position or after 20 calendar days of qualifying, whichever is the earlier.
13.11 It is understood and agreed by both parties that the training will be given first to the employees involved with the work to be filled, all standing applications will immediately done. a. a position that is filled internally by a reallocation of the existing staff; or

3. All vacancies and the ultimate vacancy is thereby identified, such vacancy new positions of twenty (20) school days duration or longer shall be advertised in all schools and centres of the school district as soon as they become known, for a period of seven (7) calendar days. The position shall be filled within ten (10) calendar days of the end of the posting period if an internal applicant is selected. Within a further five (5) working days after filling a posted position, the Board will post the name of the successful applicant in the same manner as the original posting. Vacancies arising between June 30 and August 20 of each year shall be posted in the district office. Copies of all postings shall be forwarded at the time of posting to the Association president.
4. All postings shall contain the nature of the position, and any qualifications and skills required for the position.
5. Where applicants for a position are relatively equal in qualifications and skills relevant to the vacant position, preference for positions other than posts of additional or special responsibility shall be given to teachers employed in the district in the following order of priority, provided that nothing herein shall prevent the Employer from advertising such vacancy throughout its system teacher has the necessary qualifications and skills:
a. continuing appointment teachers who apply for the posted position;
b. teachers on the recall list under Article C.20;
c. district initiated transfers;
