Posting and Filling of Vacancies. 12.1 The Employer shall, in its sole discretion, determine if and when a vacancy exists. The Employer shall likewise, in its sole discretion, determine if and when to post and/or fill a vacancy which it deems to exist. 12.2 Where the Employer determines that a vacancy exists that it wishes to fill, the Employer shall post the vacancy on the Union bulletin board. 12.3 Any postings shall clearly indicate the deadline date for application and the location or person to whom applications are to be made. The posting period shall be for not less than five (5) days from the date of posting. 12.4 The Employer shall be permitted to post vacancies both internally and externally simultaneously. However, preference shall be given to internal candidates where all factors referenced in Article 12.05 below are relatively equal as between internal and external applicants. 12.5 When filling posted vacancies, the Employer shall consider the following factors: skills, experience, abilities, qualifications, and educational background. When the aforementioned factors are relatively equal, the Employer shall consider applicants’ seniority. 12.6 In the event the Employer cancels a posting or decides that there are no suitable applicants for the vacancy, it shall post a notice to this effect to advise Employees. 12.7 If the successful applicant is an existing member of the bargaining unit, he/she shall be placed on ninety (90) day trial period upon starting the new position. During this period, the employee may elect to return to his/her former position. In the event the Employer determines, within the trial period that the employee is unable to adequately perform the normal duties of the position, the employee will be returned to his/her former position.

Posting and Filling of Vacancies. 12.1 The Employer shall11.3.1 A declared vacancy is a position to be posted and flown by Human Resources. All qualified members of the bargaining unit may apply, together with any qualified individuals not currently employed by the District. 11.3.2 A notice of each declared certificated vacancy shall be posted as soon as possible on a designated bulletin board at each school and mailed to the Association office prior to the filling of the vacancy. In addition, the vacancy will be posted on the District website. 11.3.3 When vacancies are declared, a member must apply within the time specified on the Notice of Vacancy. A closing date will be included which is at least ten (10) working days following the posting date, unless the District deems that a shorter time frame is needed, in its sole discretion, determine if and when which case a vacancy exists. Notification of amendment or withdrawal of the request must be presented in writing to Human Resources. 11.3.8 If the most senior applicant for the vacancy is not selected, then, upon written request, that unit member will receive a written explanation for the non-selection based on the above criteria. 11.3.9 Positions which become vacant after October 15 will be posted and externally simultaneouslyselections will be made. Posting and Filling of Vacancies. 12.1 The Employer shall14.01 Where a permanent vacancy exists, or where the Hospital creates a new position in the bargaining unit, such vacancy shall be posted for a period of seven (7) calendar days. Applications for such vacancies shall be made in writing within the seven (7) day period referenced herein. 14.02 Notwithstanding the above, the Hospital may fill at its sole own discretion, determine if and when without posting, vacancies caused by: (a) illness; (b) accident; (c) pregnancy and parental leaves of absence; (d) leave of absence not expected to exceed six (6) months; (e) vacation; (f) specific tasks not expected to exceed six (6) months. Employees selected to fill such temporary vacancies agree not to apply for other temporary positions while filling the temporary vacancy. Upon completion of the temporary assignment, the bargaining unit employee will be returned to her former position. Such employee shall continue to accrue seniority while filling a temporary vacancy. Employees newly hired to fill such temporary vacancy existswill not accrue seniority during the filling of such vacancy. If such employee successfully posts into a permanent position within the bargaining unit prior to the end of the non-posted vacancy, they will be credited with seniority from their last date of hire. With mutual consent the familiarization period may be extended for an additional five hundred and twenty (520) hours or part thereof. In the event the successful applicant proves unsatisfactory in the position during the familiarization period, or if the employee is unable to perform the duties of the new job classification, he/she shall be returned to the former or a similar position without loss of seniority. The successful applicant may also request a return to the former or similar position during the familiarization period without loss of seniority. The Employer need not re-post the vacancy on vacated position, but shall consider applicants from the Union bulletin boardoriginal posting. If there are no such qualified applicants then the Employer may consider applications from outside the bargaining unit. 12.3 Any postings (b) Article 12.05 (a) shall clearly indicate not apply to employees in the deadline date for application and bargaining unit who have accepted a position with the location or person Employer outside the bargaining unit. Where the assignment is for more than three (3) months it shall be posted and filled in accordance with Article 12 of the Collective Agreement. 12.07 Wherever possible, should the Employer determinesrequire, within the trial period that or the employee is unable request a transfer to adequately perform the normal duties of the positionanother position or work location, the employee transfer will be returned to his/her former positionexplored through the current transfer policy.
