When a vacancy occurs or a new position is created which is not covered under the existing classifications within the Bargaining Unit, the Company shall post such new jobs or vacancies on the bulletin boards throughout the workplace for a period of five (5) working days and before considering external applicants and will only consider external applicants, if there is no applicant from the Bargaining Unit qualified. The Company shall not use its rights in an arbitrary or discriminatory manner. Where a classification vacancy for the same classification occurs within three (3) months from a posting, then the original remaining applicants will be considered and the position will be filled from the most senior qualified individual. The Unit Chairperson shall have access to any job posting file. An Employee who will be absent due to vacation, may make written application to Human Resources for the purpose of applying for any job posting that will take place during their absence. An Employee who has attained seniority is free to apply for any posted job in which he/she can show experience or ability. In the case of a re- application, the Employee must show gained experience or ability. In filling jobs under this Section, the Employees with the greatest seniority shall be given preference over those with least seniority provided they are qualified and have the skills and ability. The Employer shall have the right to specify the qualifications required for the job. The Company shall state the numbers of vacancies, the title of the position, the rate of pay and the areas in which the position exists. Applicants who are deemed to be not qualified for a job posting shall be notified of the specific reason(s) they are not qualified. An Employee accepted on a job posting will be notified of his/her acceptance within five (5) working days after the job posting process has been completed for that individual. If such successful applicant is not assigned to his/her new job within fifteen (15) working days from the day he/she was notified of his/her acceptance, he/she will receive the wage rate of his/her new job effective on day fifteen (15). A period of up to thirty (30) working days will be given to the successful applicant to perform the requirements of the job. During such period the successful applicant will be given adequate training and instructions to demonstrate all of the processes associated with the job. The Company will not arbitrarily curtail this period. In the event that the successful applicant subsequently fails in the above noted thirty (30) working days, he/she shall be returned to his/her former job with full seniority.

5. If an RN is not selected for a new vacancy, she/he will be informed of the decision and the basis for the decision, if she/he requests.
B. Postings will include:
1. Required qualifications (based solely on observable, quantifiable and measurable performance skills).
2. Date of vacancy posting.
3. Deadline for application filing/end of posting.
C. From the time a vacancy develops until the time it is filled, the Hospital may temporarily use bargaining unit RNs as necessary to cover the vacant position.
D. Bargaining unit vacancies will be posted on the cost center of origin as well as on the Hospital’s website. PRN will receive an updated listing of all vacancies on a weekly basis.
E. Once a position has been posted, the qualifications and other posting parameters will be frozen until the position has been filled. If no qualified applicants apply, the position may be re-posted with different qualifications.
F. When a permanent vacancy occurs within a classification covered by this agreement, which the Employer intends to fill, after the Employer applies the internal job transfer bidding procedure and the ultimate vacancy is thereby identified, such vacancy shall be advertised for ten calendar days provided that nothing herein shall prevent the Employer from advertising such vacancy throughout its system or a new position is created which is not covered under outside during the existing classifications within the Bargaining Unit, the Company shall post such new jobs or vacancies on the bulletin boards throughout the workplace for a period of five (5) working days and before considering external applicants and will only consider external applicants, if there is no applicant from the Bargaining Unit qualifiedten day period.
