Posting of Vacancy. A. Upon occurrence of a job vacancy within the school district for which a bargaining unit member is certified, a notice of such position along with its requirements and job description, if applicable, will be posted in each building and on the District website at the same time the notice is given outside the school district. Additionally, the posting will be distributed through email. The district will be considered to have met this responsibility by emailing the district list on the district email system. During vacation periods, such notice shall be accomplished by mail. B. In the event a vacancy occurs during the school year, the position shall be posted, and if satisfactory applicants apply, the position shall be filled with the appointment to be effective no later than the first day of the semester following the vacancy. In the event a vacancy occurs too late in the first semester to complete the timely posting and selection of a replacement prior to the first day of the next semester, the Association and the Board shall meet to determine a mutually agreeable process/timeline to be followed. C. In order to provide existing certificated staff with the opportunity to apply for vacancies to be filled the following school year, members of the existing certificated staff shall have five (5) working days from the date of the notice to apply for vacancies occurring during the regular school year, and two (2) weeks for vacancies occurring in the summer prior to July 9th. After July 9th, the Association President and any employee who has given written notice to the Superintendent of their desire to be notified of vacancies, shall be notified of vacancies and shall have a maximum of five (5) days to apply for said position. D. In filling vacancies within the bargaining unit, selection of internal candidates is not mandatory, but deference shall be given to internal candidates. E. Employees who have indicated in writing a desire to be considered for a vacant position and who hold the appropriate certification/licensure shall be accorded an interview with the Superintendent or his/her designee prior to the position being filled. F. All supplemental positions provided for in the contract will be posted in the spring. Any positions not filled at the time or vacancies created will be posted immediately as needed. Supplemental positions will be filled in accordance with procedures outlined in 7.01 sections A, C, D, and E.

B. 1) In the event of a vacancy occurs during or newly created position which the school yearEmployer elects to fill and for which there is no valid eligible list, the Employer shall post the vacancy or new position at least seven (7) calendar days in all divisions. The posting shall be postedinclude a description of the qualifications, hours of work, typical duties, division, testing dates (as applicable), and if satisfactory applicants apply, tentative date of appointment. A copy will be given to the position Chapter Chairman. The City shall be filled provide the Chapter Chairman with the appointment to be effective no later than the first day a copy of the semester following test results and notify the vacancysuccessful employee within ten (10) working days after the final testing date. In the event a vacancy occurs too late in written test is conducted a pre-qualification list of written test results shall be established which shall remain valid for a period of one (1) year. Six (6) months after the first semester to complete the timely posting and selection of a replacement prior to the first day creation of the next semesterpre-qualification list, those employees who failed the Association written test and those employees who were on probation and thus ineligible at the Board shall meet to determine a mutually agreeable process/timeline time the last test was administered may request to be followed.
C. In order to provide existing certificated staff with the opportunity to apply for vacancies to tested. Such requests must be filled the following school year, members of the existing certificated staff shall have five (5) working days from the date of the notice to apply for vacancies occurring during the regular school year, and submitted in writing not later than two (2) weeks for vacancies occurring after the six-month date, as stated in the summer prior test notification letter. Employees passing this test shall have their names and test scores added to July 9ththe pre-qualification list; such test scores will expire on the date the pre-qualification list expires. After July 9thWhen a written test is not administered and a prequalification list is not established, employees who were on approved leave during the entire posting period, and therefore unable to apply, may submit an application within two (2) work days of their return to work and will be considered for the position if interviews have not yet been conducted. Upon the conclusion of the testing procedures for a classification within a division, an eligible list shall be created which will remain valid for the division for six (6) months from the date certified. Subsequent vacancies in that classification for that division shall be filled from the eligible list. In the event of a vacancy in the same classification as that for which the eligible list was created but in another division, those employees on the pre-qualification list (and those employees in the same classification as the vacancy who are interested in transferring from a different division) will be offered the opportunity to interview for the new vacancy. The resultant eligible list shall remain valid for that division for six (6) months from the date certified. Employees who decline to be interviewed for the new vacancy shall remain on the pre-qualification list.
Section A.1. shall be subject to renegotiation upon expiration of the collective bargaining agreement.
2) A vacancy in a classification or a newly created position within a classification shall be filled in the following order: (a) by employees in the same division with the same classification who work a different shift, (b) by promotion requests within a division and voluntary demotions from within the division, (c) by transfer requests from outside the division from employees with a classification which is equal to or higher than the classification of the vacancy, (d) by promotion requests from another division. The senior qualified employee shall receive the position according to the above procedure.
B) Employees will be placed in their new classification within eight (8) weeks of being offered the position.
C) Employees who request and are awarded their classification change shall not be entitled to request any other change for a period of nine (9) months, in the event:
1) The request was for a lower rated classification, or
2) The employee declined during the probationary trial period. In this case, the Association President and any employee who has given written notice to the Superintendent of their desire to classification shall promptly be notified of vacancies, shall be notified of vacancies and posted.
D) Employees awarded a classification change shall have a maximum probationary trial period not to exceed three (3) months to qualify for such classification. The Employer may extend the probationary period in one (1) month segments, not to exceed six (6) months. This shall permit the City to disqualify the employee prior to the completion of five (5) days such probationary trial period where lack of ability to apply for said position.
D. In filling vacancies within the bargaining unitqualify is obvious. Employees who fail to qualify shall be returned to their former classification and schedule without loss of seniority, selection of internal candidates is not mandatory, but deference and shall be given to internal candidatesthe reasons for their disqualification in writing.
E. Employees E) Any employee who have indicated in writing a desire to be considered for a vacant position and who hold feels aggrieved upon disqualification may submit the appropriate certification/licensure shall be accorded an interview with the Superintendent or his/her designee prior matter to the position being filledgrievance procedure, and the City must be able to show that the disqualification was justified.
