Preferred Eligibility. In the event a teacher becomes disabled as the result of an "on-the-job" incident, at the expiration of payment of accumulated sick leave, that teacher will be placed on a preferred eligibility list for return to employment when the disability terminates. The Board, shall not, by this Article, be construed to have waived its rights to apply for involuntary disability pension in an appropriate case.

Preferred Eligibility. Faculty members affected by faculty reductions are placed on a preferential hiring list for a period of two (2) years. If there are two (2) or more faculty members on the list determined to be equally qualified for an available vacancy, preference is given to the faculty member with the longest continuous service in the College. Faculty members wishing reinstatement under the policy notifies the College in writing of their interest and availability every six (6) months after the termination date of their contract and of any change in their telephone number, address, and qualifications.

(b) If at any time the Preferred Guarantee Trustee shall cease to be eligible to so act under Section 4.1(a), the Preferred Guarantee Trustee shall immediately resign in the manner and with the effect set out in Section 4.2(c). (c) If the Preferred Guarantee Trustee has or shall acquire any "conflicting interest" within the meaning of Section 310(b) of the Trust Indenture Act, the Preferred Guarantee Trustee and Guarantor shall in all respects comply with the provisions of Section 310(b) of the Trust Indenture Act.
