Staff Reductions. 1. The certified staff may be reduced owing to a substantial decrease in the number of pupils, changes in the makeup of the enrollment which requires modification of existing programs, as a result of substantial reductions in funds available, or for causes over which the board has no control. The classification and number of staff reductions shall be determined by the board as early as possible. 2. In the event of staff reductions the following steps will be applied: a. Step 1: Reduction in force when possible will be accomplished through normal attrition.
Staff Reductions. 13-1 The Board may cancel the employment contracts of non-probationary teachers without penalty of the District when the Board determines that there has been a justifiable decrease in the number of teaching positions. 13-2 When a justifiable decrease in the number of teaching positions within a particular endorsement area occurs, teachers occupying such positions who are employed under letters of authorization or temporary or terminal contracts, and probationary teachers occupying such positions, shall have their employment terminated first. 13-3 When the District has determined that a justifiable decrease in the number of teaching positions within a particular endorsement area has occurred or is about to occur, and that such decrease will require the cancellation of the employment contracts of one or more non- probationary teachers, the Association shall be given twenty (20) days’ notification thereof and shall be provided the opportunity for its representatives to discuss such cancellations with the Superintendent. The notification shall include the number of positions to be decreased and the discussion shall include the rationale for the decreases. 13-4 When the District has determined that a justifiable decrease in the number of teaching positions within a particular endorsement area has occurred or is about to occur, the District agrees to make reasonable efforts to avoid cancelling the employment contracts of non- probationary teachers with such endorsement area through utilization of the following guidelines: attrition, retirement, resignations, extended leaves-of-absence, voluntary transfers, intra-building assignment changes, and District-initiated transfers. 13-5 In the event a non-probationary teacher is selected, pursuant to the provisions of this Article for cancellation of contract and if the teacher is endorsed in more than one (1) area, the teacher shall be entitled to move to a position in the other endorsement area(s) in which the teacher is endorsed, provided that there is in the area a teacher currently teaching for the District who was hired at a later date than the multiple endorsed teacher and whose contract may be cancelled instead of that of the multiple endorsed teacher. Staff Reductions. In the event the District anticipates reducing the number of Principals, the District will review the plan for reductions with the Association at least five (5) business days before the matter is scheduled for action by the Board, and provide the Association with an opportunity to discuss alternatives and impacts on programs and employees.
Staff Reductions. 1. Each Year, the Board will establish a sequence of honorable dismissal lists categorized by positions and the established groups. Copies of the lists will be distributed to the Association at least 75 days before the end of the school term. With notice to the Association, the Board may move teachers from grouping one into another grouping during the period of time from 75 days until 45 days before the end of the school term. 2. If the Board has any vacancies within 24 months of the date on which the notice of reduction in force was issued, such vacancies will be advertised and offered to the staff members who were in groupings 3 or 4 who possess the appropriate certification(s) and the qualifications established by the district and/or state. Among staff members eligible for recall, the order of recall will be by seniority. The staff members with the greatest seniority will be recalled first. 5. Staff members dismissed in accordance with the above, will provide written notification by the 10th day of every month to the Board and to the Association of their desire to return to the District. Failure to notify the Board and the Association monthly of his/her intent to return to the District will forfeit all recall rights for that staff member. Staff Reductions. A. Seniority shall be defined as the licensed professional's total length of continuous service in the district as a licensed professional. Seniority will be computed and accrue from the licensed professional's first day of actual service in a bargaining unit position, and shall continue to accrue during district-approved leaves. Seniority shall not accrue during periods the licensed professional is not employed by the district (e.g., resignation, period of layoff, etc.). Upon request the District will annually give the Council a list showing the seniority of each licensed professional. If such a request is made in conjunction with a proposed layoff the District will provide the Council with copies of the personnel recommendations which are presented to the school board. B. In the event the Board, in its discretion, determines that a layoff of licensed professionals is necessary, it shall immediately provide the Council with a description of the activities and/or grade levels in which the layoffs are to take place. Affected licensed professionals shall be notified of positions affected and a proposed time schedule for the anticipated action a minimum of thirty (30) calendar days prior to the effective date of the layoff. The Administration will determine the licensed professionals to be retained by means of the following criteria: 1. A determination of whether the licensed professionals to be retained hold the proper licenses to fill the remaining position(s). 2. A determination of the seniority, as defined in Section A of this Article, of the licensed professionals to be retained. 3. A determination of the competence of a teacher being retained if the Administration desires to lay off another teacher with greater seniority. If the District desires to retain a teacher with less seniority than a teacher being laid off under this section, the District will determine that the teacher being retained has more competence, according to Paragraph D, than the teacher with more seniority who is being laid off. C. Nothing in this Article shall be construed so as to interfere with the Board's right to dismiss a contract licensed professional pursuant to the provisions of this agreement and ORS 342.805 to 342.937 licensed professional pursuant to the applicable ORS and Article 9 Section C. Staff Reductions. Staff reductions shall be made within the Region by classification, in accordance with the following procedure: (a) within the Reservations Sales Agent classification, in the event of a net reduction in the classification, the most junior employee within the affected department shall displace the most junior employee within the classification, provided that the remaining employees have the necessary skill, ability, qualifications, training and experience to perform the normal required work; (b) staff reduction within any classification shall be in inverse order of seniority, and the most junior employee within a classification may displace the most junior employee in the bargaining unit, provided the remaining employees have the necessary skill, ability, qualifications, training and experience to perform the normal required work. 11.06.01 Employees will be given written notice at least fourteen (14) calendar days in advance of layoff.
