PROBATE AVOIDANCE. Assets funded into a living trust during the property owner’s lifetime will not pass through probate. The provisions of the trust document will govern distribution of the trust assets at the grantor’s death. In some cases, the trust directs that assets continue to be held, invested, and administered for the benefit of loved ones. WHAT IS PROBATE? Probate is the court-supervised process of proving and administering a will. This process can be time consuming and expensive depending on the size and complexity of your estate. Probate requires that a full accounting of your assets and debts be made public record. Furthermore, when your will is probated, its terms generally become public record.

PROBATE AVOIDANCE. Having a Trust helps you avoid the time and expense of the probate process by managing your assets during your lifetime. (See Common Misconceptions) Assets in a Trust do not need to go through probate. Various examples of probate avoidance include: • Property held in a Trust at the time of the Grantor’s death is not subject to probate administration, thus saving in probate expenses. • Property can be distributed to the beneficiaries shortly after the Grantor’s death, avoiding much of the delay encountered with probate administration. • Property out-of-state can be transferred to the Trust to avoid probate later. For example, if a Michigan resident also owns real estate in Florida, then upon his death it will be necessary to conduct estate settlement proceedings in both states. If, however, the Florida real estate is transferred to the Trust before the Grantor’s death, the probate estate administration in Florida can be avoided. • If a Grantor becomes physically or mentally incapacitated, property held in Trust remains available to the Grantor without the requirement of a court-supervised guardianship or conservatorship.

  • No-­‐Activation Period Registry Operator shall not activate any names in the DNS zone for the Registry TLD (except for "NIC") until at least 120 calendar days after the effective date of this agreement. Registry Operator may allocate names (subject to subsection 6.2 below) during this period only if Registry Operator causes registrants to be clearly informed of the inability to activate names until the No-­‐Activation Period ends.

  • Territorial Extension At the time of signature of this Agreement, or at any time thereafter, the provisions of this Agreement may be extended to such territories for whose international relations the Government of the United Kingdom are responsible as may be agreed between the Contracting Parties in an Exchange of Notes.

  • Meal Period A Contractor shall schedule an unpaid period of not more than 1/2 hour duration at the work location between the 3rd and 5th hour of the scheduled shift. A Contractor may, for efficiency of operation, establish a schedule which coordinates the meal periods of two or more crafts. If an employee is required to work through the meal period, the employee shall be compensated in a manner established in the applicable Schedule A.

  • Compensation for Holidays Falling on Scheduled Days Off 1. When a holiday falls on a full-time employee's regularly scheduled day off, the employee shall receive eight (8) hours of compensatory time.

  • Listing Period Extension The Commission shall be due if the Property is sold, conveyed, exchanged, optioned, or otherwise transferred within _ _ days (“Extension Period”) after the expiration of the Listing Period to anyone with whom the Broker or Agency has negotiated unless the Property is listed, in good faith, with another real estate agency. The term “negotiation” shall include providing information about the Property, showing the Property, or presenting an offer on the Property. All rights under this Section shall terminate upon the expiration of the Extension Period.

  • LEAVE OF ABSENCE - UNION BUSINESS 11.08.01 Employees who have been elected or appointed to carry out business authorized by the Union on a full-time basis shall be granted a Leave of Absence for this purpose. The Union will advise the Company of the name(s) of such employee(s), the term of such leave, and the specific purpose. The Union shall repay the Company for the Company's costs incurred in Employee Benefit Plans and the employee(s) shall continue to pay their contributions directly to the Company. The Company shall provide such employees with free and reduced-rate transportation in accordance with Company regulations. Such employees shall continue to accrue seniority and service while on leave of absence.

  • Termination for Market Change (a) In the event of delay or interruption under B8.33, exceeding 90 days, and Contract has not been modified to include replacement timber, this contract may be terminated upon election and written notice by Purchaser, if (i) a rate redetermination for market change under B3.33 shows that the appraised weighted average Indicated Advertised Rate of all Included Timber remaining immediately prior to the delay or interruption has been reduced through a market change by an amount equal to or more than the the weighted average Current Contract Rate, or (ii) the appraised value of the remaining timber is insufficient to cover the adjusted base rates as determined under B3.33.

  • Probation for Newly Hired Employees (a) The Employer may reject a probationary employee for just cause. A rejection during probation shall not be considered a dismissal for the purpose of Article 11.2
