Product Enhancements. If during the Term Seller offers any improvement, additional function, or other enhancement to any Product, Seller shall offer such improvement, additional function or other enhancement to Buyer at prices that do not exceed those charged to any other of Seller's customers.
Product Enhancements. If during the term of this Agreement Seller offers any improvement, additional function, or other enhancement to any Product to another party, Seller shall offer such improvement, additional function or other enhancement to Buyer under substantially the same terms and conditions, including price.
Product Enhancements. (a) During the Term of this Agreement, INFO shall provide Distributor with modifications, upgrades, or improvements to the Products, or any part thereof, that INFO may from time to time make available that: (i) is identified as a new release of a Product, (ii) contains a modification, upgrade or improvement to the Product, (iii) is not a separately priced software component (and does not include any software that INFO distributes as a separate product) and (iv) is made commercially generally available by INFO (a "Product Enhancement"). Each such Product Enhancement will be deemed a "Product" for purposes of this Agreement, including royalty calculations. (b) INFO shall in good faith (but with no further obligation) consider any functionality changes or modifications to the Products specifically requested by Distributor to facilitate integration with Distributor products and/or exploitation of the Products in the Territory. Any such modifications which INFO commits to undertake shall be the subject of a separate agreement between the parties and shall not be deemed "Product Enhancements" for purposes of this Agreement. 1.06
Product Enhancements. Tandberg agrees to keep Avistar fully informed of any improvements to the Tandberg TC 2000 and all developments by Tandberg of other products with similar or enhanced functionality. Specifically, Tandberg agrees to give due consideration to Avistar's requested * requirements as identified in Exhibit A attached hereto and to consider, as a priority, inclusion or some or all of the identified functionality. Tandberg agrees to consult with Avistar concerning such improvements and developments with the objective of avoiding incompatibility with Avistar's tooling and applications involving the Tandberg TC 2000. However, nothing in this provision shall be construed as forming a binding commitment on the part of Tandberg to include in its development plan any or all of Avistar's requested * requirements. Tandberg shall give Avistar the opportunity, on terms not less favorable than those offered herein and to other customers of Tandberg purchasing in substantially the same quantities as Avistar, to purchase such similar or enhanced products. Avistar agrees to keep Tandberg fully informed of any improvements and/or enhanced functionality of any Avistar Systems.
Product Enhancements. During the Term, Seller shall provide the enhancements to Products and Systems in accordance with Exhibit G as it may be amended in writing by agreement of the Parties. If Seller fails to meet the delivery dates set forth in Exhibit G, Seller will be liable for Buyer’s labor and Seller’s Product to provide a work-around solution at those ONU sites and associated HDT sites requiring the additional capacity and capabilities until Seller’s scheduled enhancement is in place. The Product Enhancements listed in Exhibit G are intended to increase revenue and/or reduce costs and the pricing for these Product Enhancements will be determined by Seller and made available to Buyer 30 days prior to the general availability date.
Product Enhancements. MBI shall notify SYT of any Product Enhancements of the Commercial Product that MBI makes generally commercially available. Such Product Enhancements will be added in writing to this Commercial Agreement as an additional Commercial Product. The other terms of this Commercial Agreement shall remain unchanged, provided, however, prices may change if use rates change.
Product Enhancements. Indigo shall make available to HP, free of charge, all future improvements, enhancements and product fixes to the OEM Products which it generally makes available free of charge to its suppliers or customers . Such enhancements, improvements and product fixes shall be made available no later than made available to Indigo's suppliers or customers. To the extent that enhancements are offered free of charge by Indigo to its own customers solely for the purpose of providing a short-term sales incentive, Indigo shall not be obligated to offer such enhancements to HP free of charge.
Product Enhancements. “Product Enhancements” means any new features or other extensions or modifications of the Software developed by Company. “Product Enhancements” does not include new features or extensions or modifications of the Software to the extent incorporated into a general Update.
Product Enhancements. E2open issues 4 releases per year to innovate and improve the performance of the products and end-to-end solutions. E2open encourages Customer to stay current on the E2open platform. To balance upgrade costs and benefits, E2open recommends Customer upgrade no less frequently than every 3 years and no m additional subscription cost. Product Enhancements. During the term of this Agreement, we will make available to you any improvements to the Licensed Software. New features, modules or improvements to the Licensed Software that are not covered by this Agreement will be offered to you on the same terms and conditions provided that the fee or price will be the current fee or price for the feature, module or improvement. You will not be liable for payment for any new features, modules or improvements to the Licensed Software that you do not accept by your written consent.
