Program Manager’s Warranty. Program Manager warrants each Task and all Services rendered hereunder shall be performed in accordance with Program Manager’s Standard of Care, all Applicable Laws and the requirements of this Contract and any applicable Task Order. Program Manager shall re-perform, at no cost to Owner, any Services or Additional Services in accordance with this Contract as required to correct any error, omission, defect or deficiency arising within a period of two (2) years following the completion of all Services required under this Contract to the extent any such error, omission, defect or deficiency arises as a result of Program Manager’s failure to perform the Services or Additional Services hereunder in accordance with Program Manager’s Standard of Care. This warranty does not apply to a defect in any equipment designed and manufactured by others and furnished or specified by Owner or others acting on behalf of Owner unrelated to breach of warranty, nor does it apply to defects caused by other Service Providers. ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AS TO SUCH EQUIPMENT ARE SPECIFICALLY EXCLUDED. This warranty does not apply to any defect or deficiency caused by ordinary wear and tear, corrosion or erosion unrelated to a breach of warranty, or by operations contrary to or under conditions more severe than those permitted by written operating specifications, or by Owner’s failure to report a defect or deficiency to Program Manager not otherwise known to Program Manager within a reasonable time after the defect or deficiency becomes known to Owner.

  • Program Manager Owner may designate a Program Manager to administer the Project and this Contract. In lieu of a Program Manager, Design Professional may be designated to perform the role of Program Manager. The Program Manager may also be designated as the Owner’s Representative, and if no Owner’s Representative is designated, the Program Manager shall be the Owner’s Representative.

  • PROJECT REPRESENTATION BEYOND BASIC SERVICES 1.2.1. The State may at its option secure the services of a person or persons known as a Clerk-of-the-Works, referred to herein as a "Clerk". The Clerk(s) shall, for all purposes of this Agreement, report and be solely responsible to the State. The State may at any time dismiss the Clerk(s) for cause or convenience; however, any such action shall not affect the State's and ARCHITECT/ENGINEER'S obligations under this Agreement. In such event, the State shall use their best efforts to secure the services of a Clerk or Clerks under this paragraph as soon as is practicable if the State deems it necessary.

  • CONSTRUCTION MANAGER’S SERVICES The services which the Construction Manager shall provide include, but are not limited to, those described or specified herein. The services described or specified shall not be deemed to constitute a comprehensive specification having the effect of excluding services not specifically mentioned.

  • Professional Services Warranty Kodak warrants that it shall perform Professional Services in a professional manner using appropriately skilled personnel in accordance with generally accepted industry standards and Kodak’s then current policies and procedures. Subject to the provisions of condition 16.1 Customer’s sole and exclusive remedy under the warranty described in this condition shall be, at Kodak’s option, (1) re-performance of the non-conforming Professional Services, or (2) refund of the amount paid by Customer for the non-conforming Professional Services.

  • Operations Support Systems Functions CBT shall provide CLEC, upon CLEC's request, nondiscriminatory access to CBT's Operations Support Systems functions for pre-ordering, ordering, provisioning, maintenance and repair and billing, in accordance with the terms and schedules established in the Commission’s Arbitration Award in Case No. 97-152-TP-ARB, August 14, 1997 (“Arbitration Award”). CBT shall provide CLEC advance written notice of any material changes to CBT operating support systems functions.

  • CONTRACTOR CUSTOMER SERVICE REPRESENTATIVE Contractor shall designate a customer service representative (and inform Enterprise Services of the same) who shall be responsible for addressing Purchaser issues pertaining to this Master Contract.

OC is available when the Loop is provisioned over an existing circuit that is currently providing service to the end user. OC for physical conversions will be scheduled at BellSouth’s discretion during normal working hours on the committed due date. OC shall be provided in accordance with the chart set forth below.
