Prohibitions on Use. (a) Tenant shall not use or permit or suffer the Premises, or any part thereof, to be used by anyone else or for any other business or purpose than that specifically defined and permitted by this Article and further provided that Tenant shall not divert any portion of the Premises GLA for any other use other than the use described above.
(b) Tenant shall not permit the Premises to be used in violation of any laws or local ordinances or any way which in the reasonable judgment of Landlord will injure the reputation of, be a nuisance, annoyance, or do damage to the other tenants of the Shopping Center or Landlord, including without limitation, the sale of patently offensive material and merchandise and the use of audio devices, flashing lights, machinery and equipment creating noise or odors, or the committing of acts, which will disturb, impair or interfere with the use and enjoyment by the other tenants of their respective premises within the Shopping Center.
(c) Tenant agrees not to use or allow the Premises to be used for any auction, fire, bankruptcy or "going out of business" sales therein unless ordered by a court of competent jurisdiction after reasonable notice to Landlord and an opportunity by Landlord to be heard.
Prohibitions on Use. You will not: (i) access or use the services for an illegal, fraudulent or defamatory purpose, or (ii) take steps or actions that could do or undermine the security, integrity, effectiveness, goodwill or connectivity of the Services or the Bank (including but not limited to fraudulent, malicious or other activity that threaten to harm or cause harm to any other person). The Bank may, in its discretion, decline or refuse to act on an instructions given by you.
Prohibitions on Use. You will not (i) provide untrue, inaccurate or incomplete information about yourself, your Funding Sources or your accounts at other financial institutions; (ii) access or use the Services for an illegal, fraudulent, malicious or defamatory purpose; (iii) take steps or actions that could or do undermine the security, integrity, effectiveness, goodwill or connectivity of the Services (including illegal, fraudulent, malicious, defamatory or other activities that threaten to harm or cause harm to any other person); or (iv) reverse engineer the source code for any Software, or any of the service technology.
Prohibitions on Use. The Property is to be used by you, and any and all invitees, relatives, friends, or individuals who access, use, occupy or enter the Property (your Permitted Invitees) for general vacation purposes only. By executing below, you agree that you and your Permitted Invitees will not use the Property for hosting weddings, parties or other similar large gatherings; In addition, this Property is a non-smoking unit and no pets are allowed. Smoking inside the Property, housing any pet, hosting large gatherings, parties or weddings, or any other damage caused by you or your Permitted Invitees to the Property will result in a damage fee, which will be debited from your credit card. You hereby authorize BML to maintain an open account on your credit card in an amount equal to the Initial Payment for the purposes of seeking compensation for any damage to the Property or others caused by you or Permitted Invitees. However, the recovery by BML of any damages caused by you or your Permitted Invitees shall not be limited to the amount of the Damage Deposit.
Prohibitions on Use. You may not, and You may not facilitate or enable others to:
(a) Use any API or App in a manner other than as authorized or intended, that exceeds or circumvents rate or other limits (without obtaining Fannie Mae’s prior written consent) or is otherwise excessive, abusive or disruptive,
(b) Use any API or App to upload, distribute or otherwise specify any personally-identifiable or proprietary information of any individual or other third party,
(c) Interfere with, disrupt, abuse, damage or access in an unauthorized manner any API or App, the Xxxxxx Xxx Service or any Xxxxxx Mae system,
(d) Make any statements that purport to be or might reasonably be construed to be made on behalf of Xxxxxx Xxx or that Your Software, Derived Product or services are “approved,” “certified,” or otherwise endorsed by Xxxxxx Xxx,
(e) Misrepresent the source or ownership of Xxxxxx Xxx Content returned from an API or App or misrepresent or mask Your identity or the identity of Your Software or API client when using an API or App,
(f) Decompile, reverse engineer or xxxxx Xxxxxx Xxx Content or an API or App,
(g) Modify Xxxxxx Xxx Content for any purpose whatsoever,
(h) Use any robot, spider, site search or other device to scrape, retrieve or index Xxxxxx Mae Content or services provided by Xxxxxx Xxx,
(i) Collect or use Xxxxxx Mae Content for any illegal or unauthorized purpose,
(j) Use software that contains, transmits or distributes any malware or other computer programming of a destructive, detrimental or surreptitious nature that may damage, interfere with, intercept, expropriate or permit unauthorized access to any API or App, any Xxxxxx Xxx system, the Xxxxxx Mae Service or Xxxxxx Xxx Content,
(k) Use any API, App or Xxxxxx Mae Content with the intent to design, build, promote or augment any service competitive to the Xxxxxx Xxx Service or other Xxxxxx Mae service,
(l) Use or access any API, App or the Xxxxxx Xxx Service in any way which may undermine Xxxxxx Xxx’s business interests,
(m) Distribute, publish or sublicense an API or App, or
(n) Create an API client or platform that functions substantially the same as a Xxxxxx Xxx API or The Exchange® and offer it for use by third parties.
Prohibitions on Use. The Products are intended for connection to the room telephone wiring and to the "subscriber" side of the Federal Communications Commission ("FCC") Part 68 Registered telephone services switch (the PABX). In no event shall OEM Reseller or Customers directly connect the Products to the telephone company central office wiring which would require Registration as "Terminal Equipment" pursuant to 47 Code of Federal Regulations Part 68 of the FCC Rules. Prohibitions on Use. The End User must not:
a. use the Platform for any purpose or in any manner other than as reasonably anticipated in this Agreement;
b. use the Platform in any way that could damage CLO Central’s reputation or goodwill;
c. reproduce, make error corrections to or otherwise modify or adapt any part of the Platform;
d. create any derivative works based on the Platform; e. transfer, sublicence, rent, lease, lend or use the Platform for commercial time sharing or service bureau use;
Prohibitions on Use. Landlord will not allow the use of advertising in its rights of way or on its property for barter or allow the advertising space to be subdivided or resold by any parties other than the Landlord.
Prohibitions on Use. Subscriber will ensure that use of the Service by all Authorized Users, and all Subscriber Data, is always compliant with the intended purpose of the Service and all Laws. Subscriber hereby covenants, represents, and warrants that none of Subscriber, Authorized User, or any user of a View-Only Account will:
a) use Optigo’s Product Suite in any way that violates any local, provincial, federal, or foreign law or regulation, or that is fraudulent, false, misleading, defamatory, obscene, or pornographic;
b) use Optigo’s Product Suite in any way that is prohibited by this Agreement;
c) interfere with or circumvent mechanisms in Optigo’s Product Suite intended to limit Subscriber’s use thereof, or otherwise use the Service in a way to avoid payment of Fees;
d) abuse, interfere with, misuse, change, or disrupt Optigo’s Product Suite, including the use thereof by third parties;
e) modify, disassemble, decompile, translate, prepare derivative works of, reverse engineer or otherwise attempt to obtain or derive the source code, underlying ideas, algorithms, file formats, or non-public APIs, of Optigo’s Product Suite;
f) use Optigo’s Product Suite or Consulting Services to develop produce, build, or market a product or service substantially similar to Optigo’s Product Suite, or copy any features, functions or graphics of Optigo’s Product Suite;
g) use Optigo’s Product Suite to communicate any message or material that is harassing, libelous, threatening, obscene, indecent, would violate anyone’s the intellectual property or publicity or privacy rights, that would give rise to civil liability, or that constitutes or encourages conduct that could constitute a criminal offense, under any applicable law or regulation;
h) upload or transmit any software, content, or code that does or is intended to damage, harm, disable, overburden, impair, destroy, disrupt or adversely affect the performance of Optigo’s Product Suite, including viruses or programming routines intended to damage, surreptitiously intercept or expropriate any system, data or Personally Identifiable Information;
i) create a security vulnerability, denial of service attack or other disruptive activity, consume excessive bandwidth, or otherwise cause harm to Optigo’s Product Suite, or Optigo’s other customers and users;
j) rent, lease, reproduce, modify, adapt, create derivative works of, distribute, sell, sublicense, transfer, or provide access to Optigo’s Product Suite to anyone except an Authorized User or in...
