Xxxxxxxx Vice President Senior Water Resources Planner City of Galt 2020 Urban Water Management Plan Update PROJECT UNDERSTANDING AND APPROACH Urban water suppliers are required to prepare Urban Water Management Plans (UWMPs) to support their long- term water resource planning and to ensure that adequate water supplies are available to meet existing and future water demands. Specifically, every “urban water supplier” that either provides over 3,000 acre-feet of water per year (AFY) or serves 3,000 or more connections is required to assess the reliability of its water sources over a 20-year planning horizon considering normal, dry, and multiple dry years, among other requirements (Division 6 Part 2.6 of California water Code (CWC) §10610 - 10656). The City currently serves a population of approximately 25,000 people1 through approximately 7,200 connections2 and therefore meets the definition of an “urban water supplier” and must prepare an UWMP. The City relies on groundwater to supply potable water to its customers. Surface water and recycled water sources are not currently utilized by the City. The City’s water distribution and supply system includes several active groundwater xxxxx, several water treatment facilities, aboveground water storage reservoirs, and more than 60 miles of pipelines which range from one inch to 24 inches in diameter. The City delivers water to residential, commercial, industrial and institutional (CII) customers within its service area. EKI understands that the City recently annexed some additional land, and that the associated expansion of the water supply system will need to be incorporated in the 2020 UWMP, as well as plans for potential additional annexations. EKI’s approach to developing the City’s 2020 UWMP is informed by the key elements described below as well as our years of experience working with municipalities in the Central Valley on water supply planning and design projects.

Project Commitment. In order to qualify for incentives, a Detailed Investigation must be completed by Enovity to quantify projected savings. Once the Detailed Investigation is completed, the Customer will be issued a Detailed Investigation Report and Project Installation Agreement, and can purchase specified equipment for the energy efficiency project. Project Commitment. The Purchaser will use commercially reasonable efforts to cause the milestone events specified in Section 1.3 to be satisfied as promptly as reasonably possible following the Closing. Without limiting the generality of the foregoing, the Purchaser will cause the Company to use commercially reasonable efforts to carry out its research and development programs for VCN01 PDAC phase 2 trial and VCN01 RB pivotal trial in such manner as is reasonably necessary in order to achieve each of the milestones associated with the Milestone Payments. Notwithstanding the foregoing, the Company shall only be required to use the same efforts that a similarly situated company would reasonably devote with respect to its own product with similar commercial potential at a similar stage in the research, development or commercialization lifecycle, taking into consideration the anticipated profitability and cost to obtain the supplemental BLA and shall not be required to continue any research and development program if a prior study does not meet its primary endpoints.
Project Commitment. The City and Equity Office hereby commit to moving forward with this project, consisting of the design and construction by the City, in consultation with Equity Office, of an eight to twelve foot wide, decomposed granite, multi‐use trail along the west bank of the Creek. To accomplish this purpose, the City and Equity Office agree to negotiate in good faith as to the terms of the Design and Construction Agreement and the Permanent Easement and License Agreement.

  • Incremental Revolving Commitments (a) The Borrower may on one or more occasions, by written notice to the Administrative Agent, request during the Revolving Commitment Period the establishment of Incremental Revolving Commitments, provided that the aggregate amount of all the Incremental Revolving Commitments to be established hereunder on any date shall not exceed the Incremental Amount as of such date. Each such notice shall specify (i) the date on which the Borrower proposes that the Incremental Revolving Commitments shall be effective, which shall be a date not less than 10 Business Days (or such shorter period as may be agreed to by the Administrative Agent) after the date on which such notice is delivered to the Administrative Agent, (ii) the amount of the Incremental Revolving Commitments being requested (which shall be an amount not less than $5,000,000) and (iii) the identity of each Person proposed to become an Incremental Revolving Lender in connection therewith (it being agreed that (x) any Lender approached to provide any Incremental Revolving Commitment may elect or decline, in its sole discretion, to provide such Incremental Revolving Commitment and (y) any Person that the Borrower proposes to become an Incremental Revolving Lender, if such Person is not then a Lender, must be an Eligible Assignee and, if such approval would then be required under Section 10.6(c) for an assignment to such Person of a Commitment or Loan, must be approved by the Administrative Agent, each Issuing Bank and the Swing Line Lender (such approval not to be unreasonably withheld or delayed)).
