Promenade. Lessee hereby agrees to develop a proposal (the “Promenade Proposal”) for the promenade (the “Promenade”) which shall include opening the Promenade to the public from the promenade portion of Parcel 134 to the promenade portion of Parcel 130 (the “Promenade Project”). Lessee will provide to County not less than quarterly status updates describing the status of such efforts. Upon receipt of each of Xxxxxx’s quarterly status updates, Xxxxxx agrees to meet and confer with the County so that the County will have an opportunity to provide input and recommendations. On or before six (6) months from the Effective Date, Lessee shall present to County the scope and design of the Promenade Project, which shall be subject to the Director’s reasonable approval. As reasonably necessary to evaluate the feasibility of Xxxxxx’s proposal, County shall have the right to retain its own consultants. Xxxxxx agrees to reimburse County for the reasonable out-of-pocket costs incurred by County for such consultants. Lessee shall complete the Promenade Project within twenty- four (24) months from the Effective Date. Lessee shall be solely responsible for all costs and expenses incurred in connection with the Promenade Project;

Promenade. The Redevelopment Work includes the development by Lessee of over 1,900 lineal feet of continuous pedestrian walkway with landscaping, lighting, seating, fencing and related improvements circling the entire frontage of the waterside areas of the Premises (the “Promenade”) as described in the Redevelopment Plan and in accordance with the Final Plans and Specifications for such work described in Article 5. County hereby reserves a public easement for access over and use of the Promenade for fire lane uses, pedestrian purposes and such other related uses (including, if approved by County, bicycling, rollerblading and similar activities) as may be established by County from time to time, all in accordance with such rules and regulations as are promulgated from time to time by County regulating such public use. Such public easement shall also include the public use of any restrooms that are designated on the Redevelopment Plan or Final Plans and Specifications as public restrooms. Lessee shall be responsible for the maintenance and repair of the Promenade in accordance with commercially reasonable maintenance and repair standards for the promenade and other similar public areas located on private leasehold properties in Marina del Rey established by County from time to time on a nondiscriminatory basis. The exact legal description of the Premises encumbered by the public easement reserved herein shall be established based upon the final as- built drawings for the Promenade to be delivered by Lessee upon the completion thereof in accordance with the terms and provisions of Subsection 5.7.7 of this Lease. At the request of either party, such legal description shall be recorded in the Official Records of Los Angeles County as a supplement to this Lease.
Promenade. Walkway design and materials The Waterfront Promenade will feature enhanced paving materials to create an aesthetic quality to match the renovated property. Scored concrete modules create a sense of movement akin to the water of the marina and ocean beyond while allowing for pedestrian, bike and emergency vehicle traffic. • Fencing design and materials Fencing along the Waterfront Promenade will be marine grade railing and pickets to endure the harsh waterfront conditions of the marine environment. The fencing will provide unobstructed views, reduced maintenance and maintain the nautical aesthetic of the marina and surrounding waterfront. Bollard lights will also be installed as part of the fence and railing to provide light at the lower pedestrian level and reduce the need for additional pole lights.
Promenade. As part of the Redevelopment Work Lessee shall construct a pedestrian promenade along Fiji Way (the “Promenade”). The Promenade shall be designed and constructed in accordance with the Redevelopment Plan, the Local Coastal Plan and Marina del Rey design guidelines. County hereby reserves a public easement for access over and use of the Promenade for the pedestrian and park related uses for which they are designed and such other related uses as may be established by the County from time to time, all in accordance with such rules and regulations as are promulgated from time to time by the County regulating such public use. Lessee shall be responsible for the maintenance and repair of the Promenade in accordance with commercially reasonable maintenance and repair standards established by the County from time to time for other comparable public facilities in Marina del Rey.   • Playground ~ The playground is primarily for the use of children under the age of twelve (12). Any child caught throwing rocks, vandalizing, or hitting or teasing other children will be asked to leave the playground. Garbage ~ The storage, collection and disposal of refuse and garbage in the recreational camping areas shall be conducted as to create no health hazards, rodent harborage, insect breeding areas, accident or fire hazards, or air pollution. Bag all food garbage in plastic and tie shut before placing in the dumpster, to prevent odor and rodents which are drawn to the garbage area, such as skunks, raccoons etc. Dumpster is for normal daily household garbage, no large boxes, building supplies, carpets etc. Camper is to dispose of this type of garbage elsewhere. Garbage may be placed in dumpsters only. If a dumpster is full, do not place garbage on or around the dumpster, find an empty dumpster to place your garbage into. Bags of garbage may not be set outside your camper for any reason. Disposal or deposit of hazardous or toxic waste is prohibited. No gas, oil, batteries, or car fluids may be deposited into the dumpsters or around the dumpsters. Hazardous materials will not be disposed of by the garbage service. All debris and toys must be removed from the docks, beach and marina area. Inappropriate behavior, intoxication or shouting on docks is not allowed. Glass is not allowed on the beach area. Jet skies, wave runners, etc. are not permitted in the marina area. Tires cannot be left in the marina area under boats or tied onto docks. Fish House ~ Clean up fish cleaning facility when done with your fish cleaning and bag all fish remains. Fish cleaning house must be kept clean and all fish waste must be put into plastic bags and deposited into dumpster and cover on dumpster closed. No dumping of fish wastes into marina or dog waste stations! Swimming Pool ~ Campers are required to abide by all rules posted in and around the pool area.
