5.04 Each full time firefighter must serve a compulsory twelve-month probationary period. Promotion To qualify for up-grading from Probationer Firefighter on Probation to Firefighter Fourth, Third, Second and First Class Fire Fighter respectively, an overall xxxx of 70% must be attained. If a firefighter fails to pass, he/she shall be re-examined within sixty (60) days. As a result of his/her re- examination, the Chief may recommend that the firefighter be upgraded to the next classification or the Chief may take such other action as he/she deems necessary. Failure to qualify in re-examination shall constitute sufficient reason for dismissal. In the case of a firefighter failing to qualify for upgrading he/she shall be re-examined only in those subjects in which he/she failed to attain the required 70%. Each firefighter shall serve a period of at least one (1) year in each of 3rd and 2nd classifications, prior to upgrading to the next classification.
5.05 Whenever it is known that there will not be a Captain on duty at any fire station that normally take has an officer in charge, a designate officer shall be appointed as the officer in charge. The designate officer shall be paid at the Captain's rate for the period during which he/she is so in charge. A First Class Firefighter who desires to be considered for designation as an officer under this Article, must have a minimum of eight (8) years experience as a full time firefighter with the Markham Fire and Emergency Services Suppression Division and must have passed the written exam for Captain as outlined in the Captains’ Promotional Policy. The Captains’ Promotional Policy will not be amended without mutual consent. Under normal conditions, only those firefighters who have passed the qualifying exams for Captain will be eligible to serve as an officer in charge. Effective in 2009, the qualifying exam shall be conducted on the first Monday of March and every three (3) years thereafter or sooner if mutually agreed upon by the Corporation and the Association.
5.06 Those firefighters applying for a position of Captain must have met all of the requirements for Captain referred to in Article 5.05 and must have passed the prescribed training/evaluation period. Candidates shall be chosen in descending order based on their overall xxxx achieved at the conclusion of the Captains’ promotional process and where marks are equal, seniority with the Markham Fire and Emergency Services Department shall govern. This list of designate officers, at the conclusion of the Captains’ promotional process, will also indicate the progression that is to be maintained as Captain positions become available. For example, when a Captain's position becomes available, it shall be filled in succession by the designate officer on the top of the list. Once the designate officers are in place in descending order of marks, they will not change their respective positions at any time in relation to one another. When new candidates write for the position of designate officer, they will be chosen in descending order according to their marks and placed on the designate 'list' below the names already on the list. In-place designate officers do not have to requalify. .
5.07 A firefighter promoted to a position within any division of the Department shall serve a maximum training/evaluation period of one (1) year in the new position. His/her performance is to be evaluated after six (6) months, and twelve (12) months, as a minimum, and he/she will be confirmed in the position or returned to his/her former rank, after twelve (12) months. A letter of confirmation shall be sent to each firefighter who successfully completes the appropriate training period. The letter shall be sent as soon as possible and shall apply to all classifications, in all Divisions.
5.08 The various exams and qualifying exams mentioned in this article shall be based upon the following factors: 25% written examination 25% performance appraisal 25% practical evaluation 25% personal review The results of the exams shall be posted within four (4) years and all moves are at weeks of writing the discretion exam.

12.07 An allowance of $34.55 per week for out of pocket expenses will be paid to Fire Fighters attending the Ontario Fire College. This allowance will be adjusted every two years to reflect changes in the Consumer Price Index (CPI - 1986 Base: All Items/Toronto). The next adjustment will be made in 2010 to reflect any change in the CPI from December 2008 to December 2009, and will be effective the first of the month following the month in which the December 2009 index is reported.

If any promotional examination is not successfully completed, the candidate must re-write the examination within ninety (90) days. If the examination is not completed successfully the second time, and subject to the employee's past record and work history, he/she may be disciplined in a manner consistent with the rules and regulations of the Fire Department& Emergency Services.
12.04 At the time when examinations are posted, a list of sources of information will be provided to allow candidates to study and review the material.
12.05 In respect of transfers, on a full-time permanent basis, employees shall meet all of the requirements of the respective positions to which they are transferred. Employees so transferred shall be compensated at the appropriate rate of the new position in accordance with the salary schedule of this working agreement.
12.06 All employees who transfer to another position within the bargaining unit must remain in that position for a minimum of 3 years.

All promotions above 1st Class shall be based on the following: Seniority, leadership quality and ability as evidenced by the following: i) written exam; ii) oral presentation iii) practical component and iv) interview of the Candidate, by the Qualifying Board, using the above criteria.
12.08 Qualifying Boards A qualifying board consisting of two Deputy Chiefs, and two other Chief Officers from within the Association shall be appointed by the Fire Chief.
12.09 The Qualifying Board shall evaluate each candidates interview and oral presentation on a consensus basis.
12.10 Responsibilities of the Qualifying Board 12.10.01 Qualifying Board members shall be responsible for the composition, adjudication, marking, interviewing and assessing of each Candidate by the procedures established in consultation with Human Resources and the Fire Chief.. (2011)

12.03 After serving a twelve (12a) month probationary periodCompletion of the Fire Technology course or the Company Officer Diploma Program at the Ontario Fire College, skill competence, efficiency, training, experience and upon being successfully examined and recommended general work record with the Fire Services including any exams leading to the position for which application is made;
b) Medical fitness;
c) Passing of examinations set by the Fire Chief at twelve (12) month intervals, for the purpose of the intended promotion and not otherwise, each Fire Fighter appearance for interview before a three person neutral board of the intended promotion. All promotions shall be advanced one (1) classification every twelve (12) months thereafter until he/she has reached determined on the rank of First Class Fire Fighter. Promotion from Probationer to First Class Fire Fighter will normally take a minimum of four (4) years and all moves are at the discretion recommendation of the Fire Chief. After serving In the event of a second vacancy within twelve (12) month months of the initial vacancy, the initial ranking of candidates as determined by the board shall apply. For example, second place candidate shall be awarded the second vacancy.
18.02 Notwithstanding the foregoing paragraph, every Fire Fighter for the first year of employment shall be considered to be on probation. At the first regular meeting of council after the completion of the probationary periodperiod of one year, and upon being successfully examined and recommended by the Fire Chief at twelve (12) month intervals, and not otherwise, each Fire Inspector and/or Public Educator shall be advanced one (1) level. All moves are at the discretion of recommend to council confirmation in the Fire ChiefFighter’s rank as Fourth Class Fire Fighter or the Fire Fighter’s dismissal and council shall forthwith accept or reject the recommendation. After serving Six (6) months from the day a twelve Fire Services member leaves the bargaining unit to take another job with the Corporation, all seniority that the Fire Fighter has obtained will be forfeited for the purposes of this collective agreement and cannot be used for re-entry or promotional purposes within the bargaining unit.
