PROMOTIONS AND SENIORITY. 12.01 In making recommendations for promotions in the Department, both efficiency and years of service in the Richmond Hill Fire & Emergency Services shall be considered. 12.02 In determining a full time Fire Fighter’s length of service for seniority purposes, computation will begin on the date the full time Fire Fighter entered service with the Richmond Hill Fire & Emergency Services. For new hires starting on the same day, seniority will be determined as follows: 1) Any past service with the Corporation, ranked by Corporation start date 2) For new members not covered by item 1, seniority will be determined by the highest final exam xxxx at the end of their recruitment training. (2011) 3) If two (2) of the final exam marks are the same, seniority for the new members will be determined by lots. PROMOTIONS AND SENIORITY. (a) If an employee is promoted out of the bargaining unit, such employee may return to the unit without interruption in his/her seniority and service credits provided the return occurs not longer than six (6) months from the date of the promotion, otherwise, the employee loses all seniority, unless the parties agree otherwise. (b) Where a vacancy is created due to an employee being promoted outside the bargaining unit, the Board, at its discretion may fill such vacancy with a temporary employee for a period of six (6) months. At the conclusion of this period, the position will either be filled according to 15.01 a) or 15.02 may be applied.

Any grade below 70% shall require the firefighter within 32 working days to be re-examined in that particular area. (a) Upon completion of the first six (6) continuous months the Probationary Class Firefighter will be required to successfully complete an oral, written and practical exam prior to promotion to Fourth Class. (b) Upon completion of one (1) full year as a Fourth Class Firefighter, the Fourth Class Firefighter will be required to successfully complete an oral, written and practical exam prior to promotion to Third Class. (c) Upon completion of one (1) full year as a Third Class Firefighter, the Third Class Firefighter will be required to successfully complete an oral, written and practical exam prior to promotion to Second Class. (d) Upon completion of one (1) full year as a Second Class Firefighter, the Second Class Firefighter will be required to successfully complete an oral, written and practical exam prior to promotion to First Class. (e) A Firefightermust attain an overall percentage of at least 70% in each examination category. The examination shall be conducted by the Chief with one designate from the Association present as an observer.

In the event that a Firefighter fails to attain a total average xxxx of 65% in any of the examinations and at least 50% in each examination category, he shall be given, if necessary, two further opportunities to qualify by means of supplemental examinations, the first to be held within thirty (30) days of the date the Firefighter is informed he has not qualified and the second, if necessary, to be held within thirty (30) days of the date the Firefighter is informed he did not qualify on the first supplemental examination. A Firefighter shall not be re-examined by way of supplemental examination in the examination categories in which he obtained a grade of at least 65%. Should a Firefighter fail three (3) examinations for any one (l) rank, his employment may be terminated. 11.04 For promotion and salary purposes, the date of promotion to the next classification shall be: (a) where the Firefighter qualified for promotion without supplemental examination, the progression date as set out above in Section ll.03(a), (b), (c), or (d); or (b) where the Firefighter qualified by way of supplemental examinations, the date of the examination by which he qualified. 11.05 The questions on all examinations shall be based on subjects covered in the Welland Fire and Emergency Services Department Training Manual, plus any material pertaining to fire...

(b) Participation in the Promotion to Captain and the Platoon Chief-in- Training Programs Fire Suppression employees, who desire promotion to the ranks of Captain and/or Platoon Chief, shall participate in the mutually agreed upon Promotion to Captain and/or Platoon Chief-in-Training Programs. The parties agree to an annual evaluation and revision, if recommended, of the respective Programs by the Chief and/or Deputy Chief(s) and the Association. 10:02 Where the qualifications of the candidates for promotions based on all the factors set out in this Article are approximately equal, and then seniority shall govern. 10:03 Seniority shall be defined as the length of employment calculated from the date the employee commenced work with the Fire Department and is accumulated on a Fire Department wide basis. Seniority is lost if: (a) Employee resigns voluntarily; (b) Employee is discharged and not reinstated; (c) Employee is laid off and fails to notify the Corporation of his/her intentions to return to work within five (5) working days after notice to do so has been sent by registered mail to his/her last address on record with the Corporation and with a copy being delivered to the Association. (d) Employee fails to return to work within ten (10) working days of notifying the Corporation of his/her intentions to return to work. It is the obligation of the employee to keep the Corporation informed at all times of an address to which registered mail can be received by him/her on his/her behalf. (e) Employees below the rank of 1st Class are laid off for more than 24 months and employees of the rank of 1st Class and above are laid off for more than 36 months. (a) Should a lay-off of an employee be planned, it is recognized that despite the manner in which the factor of seniority may apply in other instances, that seniority will govern in the event of lay-off, consistent with the ability of the employee to perform the work. (b) In the event of recall, employees shall be recalled in the order of their respective Fire Department wide seniority, consistent with the ability of the employee to perform the work.
