15.01 Job Posting
13.01 (a) Where When a new position is created, or when a vacancy occurs, which the Employer determines that a vacancy exists within wishes to fill (which shall include the resignation of an incumbent, inside the bargaining unit), the posting will be made available for ten (10) working days via the applicant tracking system (for which training and support shall be provided) within thirty (30) working days of the vacancy occurring. The successful applicant shall be determined within ten (10) working days from the closing of the posting. The employer shall make every effort to place successful applicant in the position within ten (10) working days of being awarded the position.
(b) Such notice shall contain the following information: Nature of position, qualifications, required knowledge and education, skills, hours of work, shifts, location within the Home (ie Floors), wage or where a temporary vacancy arises salary rate or range. This is for information purposes only and is subject to change based on operational requirements. In the case of existing jobs the wage shall be as already mutually agreed to by the Joint Pay Equity Committee.
(c) The term “permanent vacancy” as used in this Agreement shall be defined as a result of the necessity to replace an employee on a leave of absence expected to be for six (6) weeks or longer, the Employer shall post a notice of vacancy for a period of seven (7) calendar days. It is understood and agreed that the subsequent vacancies arising from the filling of an initial vacancy will likewise be posted for a period of seven (7) calendar days. Employees who are on a leave of absence permanent job opening of more than one forty-five (145) week working days’ duration. A “temporary vacancy” shall be defined as a job opening of less than forty-five (45) working days’ duration, or longer with the approval of the Union, except that vacancies of more than forty-five (45) working days caused by employees being on vacation, will complete a form provided by the Employer if they wish to be considered for any position for which they qualify during their period of absence. Where the posting is for a position considered to be a permanent positionoff sick, and the successful applicant is on WSIB, or on an approved leave of absence, or on a short term task of less than six (6) months, shall be considered temporary also.
i) The Employer will have the option of filling temporary vacancies either through the posting process or by back-filling with regular part-time staff. Should the Employer decide to post the temporary vacancy, Employees interested in filling temporary vacancies of anticipated duration of greater than forty-five (45) working days, and all subsequent vacancies arising out of the initial posting, shall apply to the initial posting. The position shall be awarded to the applicant to the initial vacancy according to Article 13.02
(a) Subsequent openings will be awarded to those applicants according to seniority. Full Time employees are excluded from applying to temporary Part Time position.
ii) Employees interested in filling temporary vacancies of anticipated duration of greater than thirty (30) working days, and all subsequent vacancies arising out of the initial posting, shall apply to the initial posting. The position shall be awarded to the applicant to the initial vacancy according to Article 13.02
(a) Subsequent openings will be awarded to those applicants according to seniority. Full Time employees are excluded from applying to temporary Part Time position.
iii) For pregnancy/parental leaves, approved Leaves of Absence or WSIB leaves that are expected to exceed six (6) months in duration, they shall be awarded considered temporary also.
(e) For purposes of this article subsections a) & b) working days shall be defined as Monday to Friday exclusive of Saturday and Sunday.
(f) The successful applicant will be contacted by the position employer either in accordance with seniority should they possess person or by phone, as the necessary qualificationscase may be. The Employer shall temporarily fill the position until the successful applicant returns from will have a period of 24 hours to confirm their approved leave acceptance of absencethe offer or to refuse it. In the absence of confirmation received in the 24 hours the employee will be deemed to have refused the job offer and the employee next in line will be offered the posting. The next employee in line the same rules will apply to that applicant.
(g) Where contact is made by telephone the employer will leave a message if the call is not answered, and if this is possible, indicating the reason for the call is a job offer based on the posting the employee applied for and that the response is required within 24 hours. The employer will leave the date and time of the call on the message and keep a record of the same.
(h) Employees who have applied for a position or may be considered for a subsequent position, are responsible to submit in writing their desire to accept the posting or subsequent position if awarded, if they will not be available to accept a confirmation call as set out above.
(a) In selecting a candidate to fill a vacancy within the bargaining unit, preference shall be given to that employee with the greatest seniority, provided that they have the qualifications and ability to do the job efficiently. The “greatest seniority” shall mean the seniority accumulated at the time of the job posting.

A reduced full-time employee in vacancy within the Bargaining Unit and if successful shall retain the right to their permanent position and status and maintain all the rights of the Collective Agreement.
15.05 Staff assignments, recalls, transfers or promotions will be made based on knowledge, skills and ability to perform the position (without formal training but with a temporary reduced full-time position may apply for a temporary full-time positionreasonable orientation and familiarization period) with seniority as the determining factor where candidates are relatively equal.

15.01 Job Posting
(a) Where Prior to filling any staff changes (including new positions) or promotions, covered by the Employer determines terms of this Agreement, the Board shall notify the Union, in writing, of the position open. When jobs are vacated or the Board receives notice of pending vacancies, the Board shall post such positions within 10 days or advise the Union of their intentions regarding the position(s). Copies of the job posting will be posted on the District webpage and emailed to each school/work site for posting on the bulletin board. In order that all members will know about the position and be able to make written application, therefore, the closing date of such applications will be not sooner than five (5) working days from date of mailing. Such postings will contain the following information: a vacancy exists summary of job duties, qualifications required for the job, classification wage rate, location, shift, date of commencement and, if temporary, an end date. No advertisement for additional employees shall be made until after such posting has been completed. The Union shall be supplied with a list of all applicants. Notification of the successful applicant will be posted within five (5) working days after the closing date of bulletin. The Board shall provide bulletin boards in suitable locations upon which the Union shall have the right to post notices of meetings and such other notices as may be of interest to the employees.
(b) In making staff changes, the senior employee having the ability, knowledge, and qualifications to perform the work shall be appointed. To assist in the procedure the employer may require proof of qualifications (e.g. journeyman's ticket, appropriate licence, typing speed, etc.).
(c) Conditional on satisfactory service the trial promotion shall become permanent after the period of fifteen (15) working days within the employee’s current classification/department. Employees who are changing classifications/departments will have a thirty (30) calendar day trial period In the event the successful applicant proves unsatisfactory, or the position proves unsatisfactory to the applicant, during the above mentioned trial period, the employee shall return to his/her former position without loss of seniority and/or salary, and any other employee promoted or transferred because of the rearrangement of the positions shall also be returned to his/her former position without loss of seniority or salary in his/her former position. If the successful applicant does return to his/her former position within the trial period, the Board will make use of the applications from the original posting for the purpose of filling the vacancy, without any additional posting of the position. If no other applications were received, the Board may proceed to advertising outside of the bargaining unit forthwith. The parties will meet annually, or as needed, to determine the different classifications/departments within the bargaining unit.
(d) The Board agrees that it will give preference in non-bargaining unit staff appointments, including new positions, to members of the Union before non-Union members or where new employees.
(e) Any objections to staff changes by the Union shall be construed as a difference between the persons bound by the Agreement pertaining to the operation thereof as provided for under grievance procedure.
(f) The Union shall be notified of all appointments, hiring, lay-offs, rehiring and termination of employment as they apply to regular and temporary posted positions.
(g) When a temporary vacancy arises as posting is to be made a result permanent posting, a Notice of Vacancy will be posted and the procedure outlined in Article 5 (a) will apply. If a temporary posting is extended beyond the initial leave period, management can re-appoint the incumbent of the necessity to replace temporary posting for the extended leave period and the person holding the temporary position can bid out since they have filled or completed the initial period. All temporary 10, 10 ¼ and 10 ½ month postings will end June 30th of the current school year. All temporary postings will have an end date and include the phrase “or earlier depending upon return of the incumbent”. 15.01 28.1 Job PostingPostings
(a) Where the Employer determines that When a vacancy exists new position is created within the bargaining unit, or the College shall post notice of the new position. The posting shall be placed on the Human Resources website for a minimum of one week, and in college publications where appropriate and timely, so that all members will know about the new position. A copy of the job posting shall be forwarded to the Union, and to each xxxxxxx in the bargaining unit. Should the new position be a temporary one, the posting shall clearly state that should any other regular employee be selected to fill the position it will be on a substitution pay basis.
(b) When a vacancy arises occurs which the College intends to fill, it shall be posted as outlined in (a) above, except in the cases of temporary vacancies which shall be filled as follows:
(1) Regular employees in the same department and/or work area shall be given the first consideration in filling the position in a result substitution pay situation, without posting, pursuant to the criteria for substitution established under Clause 19.5 (Vacation Relief).
(2) If the temporary vacancy is not filled by a regular employee in the same department and/or work area it shall be posted, clearly stating that should any other regular employee be selected to fill the position, it will be on a substitution pay basis pursuant to the criteria for substitution established under Clause 19.5 (Vacation Relief).
(c) Temporary vacancies or new positions not exceeding 120 calendar days may be filled by an on call employee without posting, provided that the provisions of (b)(1) above have been fully exhausted. Extension of this 120 day period must receive prior approval of the necessity to replace an employee on a leave of absence expected to be for six Union in writing.

15.01 Job Posting

16:04 In the necessary qualifications. 15.01 26.1 Job PostingPostings

(d) Regular employees who have passed their initial probation period and who are successful in applying to full-time or part-time temporary positions that represent a promotion or lateral move will have their former position protected.

15.01 Job Posting

16.02 Posted vacancies will state the job classification, location, requirements of the job, the rate to be paid and whether or not shift rotation is involved. An employee wishing to apply for the vacancy shall do so in writing using the prescribed form during the posting period.
(a) When a secondary vacancy occurs due to the transfer of an employee into the initial vacancy, it shall be posted for four (4) working days.
(b) Subsequent vacancies due to the transfer of employees into secondary vacancies shall be posted for three (3) working days.
(c) If there is no qualified applicant, the vacancy may be filled by a new hire provided that no outside advertising of a vacancy shall be placed until present employees have had the opportunity to apply in accordance with the job posting procedures.
16.04 The Parties recognize that promotion within the service is desirable and that job opportunity and security shall increase in proportion to length of service. It is therefore agreed that in all cases of vacancy, promotion, transfer, layoff and recall after layoff, senior employees shall be given preference.
16.05 In promotions, demotions, transfers, the following factors shall be considered:
(a) length of continuous service;
(b) knowledge, efficiency and ability to do the work;
(c) physical ability to perform the functions of the position; Unless an applicant junior in seniority should they to the senior qualified applicant is significantly more qualified in factors (b) and (c), the senior applicant shall be the successful applicant.
16.06 The Corporation shall be free to temporarily fill a vacancy during the posting period by appointing a qualified person according to seniority.
(a) The successful applicant appointed to a posted permanent vacancy shall be placed on the job for an assessment period of four hundred and fifty (450) hours worked. Conditional upon satisfactory service, such transfer shall be confirmed after the successful completion of the assessment period. In the event the successful applicant proves unsatisfactory in the position during the aforementioned period, or if the employee finds the new position unsatisfactory, he shall be returned to his former permanent position without loss of seniority and wage or salary, within a reasonable period of time following written confirmation by the Human Resources Department. The Union will receive a copy of this written confirmation. Such decision by either Party will not prejudice further consideration of the employee for any other vacancy.
(b) The successful applicant appointed to a posted temporary vacancy shall be placed on the job for an assessment period of four hundred and fifty (450) hours worked. Conditional upon satisfactory service, such transfer shall be confirmed after a period of four hundred and fifty (450) hours worked. In the event the successful applicant proves unsatisfactory in the position during the aforementioned period, he shall be returned to his former permanent position without loss of seniority and wage or salary, within a reasonable period of time following written confirmation by the Human Resources Department. The Union will receive a copy of this written confirmation. The Parties agree that the position competition may not have to be re-posted if within the above noted assessment period, and where there are qualified candidates of the bargaining unit who have applied in the original competition.
16.08 When the Corporation decides to withdraw or postpone the filling of a vacancy, the Union shall be notified in writing addressed to the President/Secretary of the Union. Postponement in excess of six months will require reposting before being filled.
16.09 In cases of promotion requiring higher qualification or certification, the Corporation shall give consideration to the senior employee who does not possess the necessary required qualifications, but is preparing for final qualifications prior to filling of a vacancy.
16.10 The Union shall be notified of all appointments, hirings, layoffs, transfers, recalls and terminations of employment.
16.11 When an employee through compensable injury or disease is unable to fulfil the normal requirements of his job, he may be assigned to other work which he is able and qualified to perform, where such work is available and provided that he shall not displace any employee with greater seniority.
16.12 The Corporation will endeavour wherever reasonable and practicable to give interested employees, in accordance with seniority, the opportunity of gaining experience from time to time in other work operations to enable such employees to qualify for higher-paid positions. During any such temporary training period, there will be no change in the basic rate of pay of any employee involved.
16.13 The successful applicant appointed to a posted vacancy will be prepared to actively work in that position within twenty (20) working days of being awarded the position. If placement is delayed by the Corporation, the employee shall receive the applicable rate of pay beginning on the twenty-first (21st) day. The Employer assessment period for such employees shall temporarily fill the position not commence until the successful applicant returns from their approved leave of absenceactually commences work in the position. If he is medically unfit or unavailable to report, the Corporation may repost the vacancy and the employee will be returned to his former permanent position.
16.14 Successful and unsuccessful applicants shall be so advised, within twenty (20) days of the selection of the successful candidate. The name of the successful applicant will be posted and the Union will be notified.
(a) In vacancies of twenty (20) working days or less which the Corporation intends to fill, a qualified person from within the Department shall be appointed according to seniority.

15.01 Job Posting
(a) Where Prior to filling any staff changes (including new positions) or promotions, covered by the Employer determines terms of this Agreement, the Board shall notify the Union, in writing, of the position open. When jobs are vacated or the Board receives notice of pending vacancies, the Board shall post such positions within 10 days or advise the Union of their intentions regarding the position(s). Copies of the job posting will be posted on the District webpage and emailed to each school/work site for posting on the bulletin board. In order that all members will know about the position and be able to make written application, therefore, the closing date of such applications will be not sooner than five (5) working days from date of mailing. Such postings will contain the following information: a vacancy exists summary of job duties, qualifications required for the job, classification wage rate, location, shift, date of commencement and, if temporary, an end date. No advertisement for additional employees shall be made until after such posting has been completed. The Union shall be supplied with a list of all applicants. Notification of the successful applicant will be posted within five (5) working days after the closing date of bulletin. The Board shall provide bulletin boards in suitable locations upon which the Union shall have the right to post notices of meetings and such other notices as may be of interest to the employees.
(b) In making staff changes, the senior employee having the ability, knowledge, and qualifications to perform the work shall be appointed. To assist in the procedure the employer may require proof of qualifications (e.g. journeyman's ticket, appropriate licence, typing speed, etc.).
(c) Conditional on satisfactory service the trial promotion shall become permanent after the period of fifteen (15) working days within the employee’s current classification/department. Employees who are changing classifications/departments will have a thirty (30) working day trial period. In the event the successful applicant proves unsatisfactory, or the position proves unsatisfactory to the applicant, during the above mentioned trial period, the employee shall return to his/her former position without loss of seniority and/or salary, and any other employee promoted or transferred because of the rearrangement of the positions shall also be returned to his/her former position without loss of seniority or salary in his/her former position. If the successful applicant does return to his/her former position within the trial period, the Board will make use of the applications from the original posting for the purpose of filling the vacancy, without any additional posting of the position. If no other applications were received, the Board may proceed to advertising outside of the bargaining unit forthwith. The parties will meet annually, or as needed, to determine the different classifications/departments within the bargaining unit.
(d) The Board agrees that it will give preference in non-bargaining unit staff appointments, including new positions, to members of the Union before non-Union members or where new employees.
(e) Any objections to staff changes by the Union shall be construed as a difference between the persons bound by the Agreement pertaining to the operation thereof as provided for under grievance procedure.
(f) The Union shall be notified of all appointments, hiring, lay-offs, rehiring and termination of employment as they apply to regular and temporary posted positions.
(g) When a temporary vacancy arises as posting is to be made a result permanent posting, a Notice of Vacancy will be posted and the procedure outlined in Article 5 (a) will apply. If a temporary posting is extended beyond the initial leave period, management can re-appoint the incumbent of the necessity to replace temporary posting for the extended leave period and the person holding the temporary position can bid out since they have filled or completed the initial period. All temporary 10, 10 ¼ and 10 ½ month postings will end June 30th of the current school year. Upon mutual agreement with the Union, the Employer may post a position externally and internally at the same time.
15.04 In filling non-management vacancies, making promotions and staff transfers, seniority will be the determining factor, provided that applicants have demonstrated the ability and/or qualifications to perform the normal requirements of the job. The successful applicant shall be advised, in writing, of their appointment, with a copy to the Union.
15.05 Bargaining unit employees who are unsuccessful shall receive the reason(s) in writing.
15.06 In the event that a permanent employee is completedthe successful candidate for a Contract or Project position, that employee shall retain their permanent status, with all rights and privileges thereto and shall maintain the right to return to their previously held position, if it still exists. If an employee resigns from a temporary position before Should the position is completedno longer exist, they are not entitled to another temporary the normal layoff/recall language shall apply.
15.07 Successful candidates and recalled employees (ie. layoff and recall) recalled into a position until other than their own shall serve a trial period of forty (40) days worked. During the position resigned from is completed. Where there are two concurrent postings, and where one is permanent and the other is temporarytrial period, the employee may only have one of return to their previous position (or return to layoff) upon request. Any affected employees shall be returned to their former positions.
15.08 When an Employee is hired into a Bargaining Unit position, starts a new position, or has a contract extended, the positions, (the permanent or the temporary). There union will be no holding notified and copied on the correspondence to the employee.
15.09 The Employer can show preference to applicants based on funding and/or equity priorities, by hiring new employees on the basis of these positions. A part-time employee who is residence, lived experience, and or inclusion in a temporary part-time or a reduced full-time position may apply for a temporary full-time positionracialized group. A reduced full-time employee in a temporary reduced full-time position may apply for a temporary full-time positionExisting Bargaining Unit members shall have first consideration.

15.01 Job Posting
a) Where Role of Seniority in Posted Vacancies For each permanent bargaining unit vacancy, which the Employer determines that a vacancy exists within the bargaining unitintends to fill, or where when a temporary vacancy arises as a result of the necessity to replace an employee on a leave of absence expected to be for six (6) weeks or longernew permanent bargaining unit position is created, the Employer shall post a notice of the vacancy on bulletin boards for a period minimum of seven (7) calendar daysdays and shall notify staff through their work email address. It is understood Interested employees must apply for the position within the closing date included in the notice. A copy of the posting will be provided to the Local’s Recording Secretary. Temporary positions that are expected to be less than sixty (60) days do not require posting and agreed that the subsequent vacancies arising may be filled from the filling among part-time and casual employees in order of an initial vacancy will likewise be posted for a period of seven (7) calendar days. Postings for subsequent vacancies will identify the area, line or assignment if applicable, but will not be numbered. Staff members seniority to employees who are interested in applying for posted positions will indicate their interest by signing available and who have the posting notice skill, ability and qualifications to perform the work of the position. Temporary vacancies that are expected to last longer than sixty (60) days shall be posted. At the end of the temporary vacancy, an employee who fills a temporary vacancy shall be returned to the position she held prior to filling the indicated posting deadline. Employees who are on a leave of absence of more than one (1) week or vacation, will complete a form provided by the Employer if they wish to be considered for any position for which they qualify during their period of absence. Where the posting is for a position considered to be a permanent position, and the successful applicant is on an approved leave of absence, they shall be awarded the position in accordance with seniority should they possess the necessary qualificationstemporary vacancy. The Employer shall temporarily fill not be required to post second and subsequent temporary vacancies caused by filling the first temporary vacancy, but will offer the position until in order of seniority to employees who have the successful applicant returns from their approved leave skill, ability and qualifications to perform the work of absence.
b) An employee the position. A full-time employee, while filling a temporary vacancy, shall not be entitled to post eligible for any other temporary vacancy after having been successful in two permanent postings in until four (4) weeks prior to the calendar year. Furthermore, an employee in a expiry of the initial temporary position shall not be entitled to apply for another assignment and the Employer will fill the resulting remainder of the initial temporary position until assignment by offering the position occupied is completed. If an employee resigns from a temporary position before in order of seniority to employees who are available and have the position is completedskill, they are not entitled ability and qualifications to another temporary position until perform the position resigned from is completed. A reduced full-time employee in a temporary reduced full-time position may apply for a temporary full-time order of seniority to employees who are available and have the skill, ability, qualifications to perform the work of the position.
15.02 Such notice shall include the following information: nature of position, location, current rotation, qualifications for the position and wage or salary rate or range. Such qualifications may not be established in an arbitrary or discriminatory manner. Postings shall include posting date and closing date.
15.03 The Employer reserves the right to advertise new or vacant positions as deemed necessary. Internal applicants that meet the requirements, including qualifications as set out in the job posting for the job for new or vacant positions will be considered before outside applicants are considered for the positions.
