Promotions Outside the Bargaining Unit. An employee who accepts promotion to a position outside of the bargaining unit but within the agency, shall have the right to return to a vacant position within the bargaining unit provided such return is not occasioned by a layoff. If such employee returns to a position within the bargaining unit within one (1) year of the date he/she left such unit, he/she shall be given:
