Leave of Absence for Jury Duty. All regular employees and all regular part-time employees under court orders for jury duty shall be granted leave of absence with pay. Such sums as shall be paid by the court, minus expenses, shall be forwarded to the School District if jury duty occurs on a contracted day. The employee shall supply documentation of absences and amount of compensation.

Leave of Absence for Jury Duty. Where an employee is called to and reports for jury duty, or is called to testify as a subpoenaed witness by the Employer or its client, to testify in connection with incidents that occurred during the course of the employee’s employment with the Employer or is called to testify by the Crown as a witness in any proceeding, the employee shall be paid the difference between the pay received for such duty or testimony and the pay that would have been received at the employee’s normally scheduled work day at the regular rate for time lost. Seniority and pension rights will continue to accumulate during an absence of this nature, where applicable. Where an employee is summoned for jury duty selection, the employee otherwise scheduled for midnight shift will choose the shift prior to or after the said leave.
Leave of Absence for Jury Duty. It is the mutual intent of the District and the SMMCTA that Jury Service be encouraged but also limited as far as practical to the period of time when the continuity of instruction would not be adversely affected. The Employer's obligation to pay an employee for jury duty as provided herein is limited to a maximum of forty-five (45) consecutive calendar days or the length of the trial in any calendar year. In order to receive the payment above referred to, an employee must give his or her department head prior notice that he or she has been summoned for jury duty and must furnish satisfactory evidence that he or she performed such jury duty on the days for which such payment is claimed. The provisions of this section are not applicable to any employee who, without being summoned, volunteers for jury duty. If a part-time employee is called for jury duty, the Employer will attempt to schedule the employee in a manner to minimize the conflict. If an employee spends eight (8) or more hours in any day on jury duty, that employee shall not have to work all or part of any shift the employee is scheduled to work on that day, unless the employee desires to work the additional time.

In such cases, all jury fees shall be signed over to the Employer excluding mileage. In order to receive the payment referred to above, an Employee must give his Department Head prior notice that he has been summoned for jury duty and must furnish satisfactory evidence that he performed such jury duty on the days for which he claims such payment. In the event that the employee is excused from jury service on any day before 1:00 p.m., he must return to work for the balance of the work day in order to receive any City pay for the day. This paragraph shall not apply in cases where the employee is serving jury duty at a location outside of Berrien County.

Leave of Absence for Jury Duty. Leave of absence for jury service shall be granted to any classified employees who have been officially summoned to jury duty in local, State or Federal Court. Leave shall be granted for the period of the jury service. The employee shall receive full pay while on jury duty. The employee shall turn into payroll the pink jury service verification form and the Code of Civil Procedures §215 (Jury Service Waiver Form). Any meal, mileage and or parking allowance provided the employee for jury duty shall not be considered in the amount received for jury duty. Request for jury service should be made by presenting the official court summons to jury service to the immediate supervisor.
