The Department designates the individual(s) identified in Exhibit G as its representative with express authority to bind the Department with respect to all matters requiring the Department’s approval or authorization. Subject to the limitations on their authority specified in Exhibit G, these representative(s) shall have the exclusive authority to make decisions on behalf of the Department concerning estimates and schedules, construction budgets, changes in the Work, and execution of Change Orders or Change Directives, and shall render such decisions promptly and furnish information expeditiously, so as to avoid unreasonable delay in the services or performance of the Work of the Construction Manager. In order for the Department to effectively manage the Project and assure that the Construction Manager does not receive conflicting instructions regarding the Work, the Construction Manager shall promptly notify the Department’s representative upon receiving any instructions or other communication in connection with the Construction Manager’s Work from any employee of the Department or other purported agent of the Department other than the Department’s designated representative.
Protection of Existing Elements. The Design-Builder shall be responsible for installing sediment and erosion control measures, inclusive of, but not limited to: silt fencing, inlet protection, stabilized construction entrances, and other control measures.
