Common use of Reclassification of Position Clause in Contracts

Reclassification of Position. a) An employee shall not have his/her salary reduced by reason of a change in the classification of his/her position that is caused other than by the employee. b) Any employee whose salary has been protected by a provision of any Component Agreement at any time before July 31, 1977, or whose salary has been protected by any agreement between the Employer and the Union since July 31, 1977, or whose position classification is changed to one with a lower maximum salary through no fault of his/her own, shall receive fifty percent (50%) of the negotiated salary increase applicable to the employee's new classification. Such employee shall receive the full negotiated salary increase when the maximum salary of his/her classification equals or exceeds the salary which he/she is receiving.
