Common use of Reclassification of Position Clause in Contracts

Reclassification of Position. (a) An employee shall not have his salary reduced by reason of a change in the classification of his position that is caused other than by the employee. (b) Effective January 1, 1990, an employee who exercises his/her seniority rights to occupy a higher paying term certain or summer position, is deemed to be substituting for pay only and when returning to his/her former position, will revert to the wage rate for that former position. (c) The employee shall continue to receive 50% of the negotiated salary increases applicable to the employee's new classification until the salary of the employee's new classification equals or exceeds the salary which the employee is receiving.
