Common use of Reduction and Increase of Hours Clause in Contracts

Reduction and Increase of Hours. For the purposes of this Section, there shall be five (5) classifications: General Clerk, Clerk Cashier, Service Clerk (as set out in subsection 14.08 of this Section), Bakery Clerk, and General Merchandise Clerk. Preference in available hours of work in a store shall be given to senior employees in the same classification within the store, provided they are available and can perform the work, subject to Section 14.06 of this Section. It is understood that the employee shall assume his or her responsibility in notifying or in reporting any violation of the Seniority Clause in the allocation of hours at the earliest possible time. Any monetary adjustment or compensation arising from incorrect scheduling shall not be paid retroactively for a period greater than two (2) weeks prior to the time the Grievance was first lodged. The Employer will endeavour to maximize the number of hours scheduled for part-time employees in accordance with their seniority and the Collective Agreement, provided they are available and can perform the work and provided they have not restricted their availability. The foregoing does not imply an obligation to schedule more hours in any classification than the Employer has determined are necessary.
