REDUCTION IN PERSONNEL. A. Lay-Off Procedure. It is recognized by the parties to this Agreement that such things as lack of finances, changes in educational programs and decreases in enrollments may necessitate reduction in the teaching staff. In order to promote an orderly reduction, the following procedure will be used: 1. Probationary teachers will be laid off first according to date of hire, provided there are certified and qualified teachers remaining to fill the positions being vacated. 2. In the event that tenured teachers must be laid off, layoff will be on the basis of seniority according to date of hire provided there are certified and qualified teachers remaining to fill the positions being vacated. 3. By October 1, the Board shall furnish the Association President with a listing of all teachers in order of seniority and specify each teacher's most recent certification. Upon request of the Association President, each subsequent October 1, additions, deletions and corrections to the list will be provided by the Board. 6. Employees on layoff do not acquire seniority while on layoff but seniority before layoff shall be reinstated when the employee is rehired. 7. Substitute teachers and other temporary teachers do not acquire seniority but contracted teachers will acquire seniority prorated to the amount of time employed. 8. Teachers displaced by a layoff or the elimination of a position may bump for positions if they are certified and qualified (certified in a particular subject area or grade) and have more seniority. This must be done in writing to the Superintendent within five (5) days after receipt of notice of displacement. If a displaced teacher is certified but not qualified to bump any junior teacher, the displaced teacher may bump the teacher with the least seniority assigned to a position for which the displaced teacher is certified provided: (a) The displaced teacher has more seniority. (b) The displaced teacher shall have the opportunity to become certified and qualified prior to the start of the position. (c) The displaced teacher will have two (2) years to become certified and qualified. The Board shall reimburse the displaced teacher for 100% of the actual cost of the tuition for the courses required for qualification. 9. Seniority will be defined as continuous service as a teacher with Grass Lake Community Schools, starting with the individual's date of hire. 10. Recall from layoff shall be in inverse order of layoff for positions for which the teacher is certified and qualified. The term “seniority” as hereinafter used shall mean length of continuous employment in the Adult Daytime High School Completion Program by the District as a teacher from the last date of hire with this program. Seniority within the ADHSC program shall not accrue nor be forfeited if a teacher leaves the program and is employed in another teaching or administrative capacity for Cadillac Area Public Schools. A teacher shall be “employed” for seniority purposes when performing ADHSC Program teaching services in the District for pay. Teachers on lay-off may, at their option, reimburse an unpaid leave of absence will accrue seniority during the leave of absence. Substitute teachers or reserve teachers shall not accumulate seniority while in that status. Credit for outside the District teaching experience shall not count for seniority purposes. 4. The District shall prepare a seniority list of teachers in the Adult Daytime High School Completion Program by semesters of employment in this program as a teacher from the last date of hire and transmit a copy to continue their fringe benefits for one (1) year. Timely payment the Association on or before the first day of November and March of each year of this reimbursement contract.
5. An employee shall lose his/her seniority for the following reasons only:
a. The employee quits or retires.
b. The employee is discharged or terminated.
c. The employee does not return upon recall within fifteen (15) working days after notification has been sent.
6. The seniority list herein is solely for those in the responsibility classification of Adult Daytime High School Completion Program teachers and conversely the teacherK-12 teacher seniority list (Ref. K-12 Article XVII, D) is for their classification and, thus, seniority rights may not be transferred between seniority lists.

Leaves of absence without pay and periods on the basis reduction in personnel shall not accumulate as seniority but shall not operate as a break in continuous service. A list of seniority according to teachers' first date of hire provided there are certified and qualified teachers remaining to fill the positions being vacated.
3. Whenever possible, notice of layoff will be given at least sixty (60) calendar days prior to the time the layoff is to take effect, but not less than fourteen (14) calendar days. As soon as conditions change allowing recall to take place, notice of such recall work shall be immediately given prepared and published no later than ninety (90) days from the first day of each school year. Prior to serving the notice for reductions in accordance personnel, a seniority list shall be prepared and published. Those teachers with subparagraph 10 and 11 of this Article.
4. In the circumstances of more than one individual beginning employment on the same date, all individuals so affected equal seniority shall participate in a drawing to determine position their ranking on the seniority list. The Association and teacher(s) so affected shall will be notified in writing of the date, place, and time of the drawing. The drawing shall be conducted openly and at a time and place which shall that will reasonably allow the affected teachers and Association Representatives representatives to be in attendance. A copy of the seniority list shall be provided to the Association. Lose seniority – seniority shall be lost for any of the following reasons:
1. Employee quits
2. Employee is terminated
3. Employee retires
4. Employee on layoff does not respond to a recall notice within the fourteen (14) day period stipulated in this CBA.
5. By October 1Employee has been on layoff for thirty-six (36) months. (after 36 months of being on the layoff list, the Board laid off employee is removed from the layoff list and no longer has any employment relationship with the District.)
6. Employee abandons their position – employee does not report to work for five days and does not report their unavailability to work.
B. No teacher shall furnish be reduced pursuant to a reduction in personnel unless the Association President with a listing teacher is provided written notice of all teachers in order of seniority and specify each at least sixty (60) days sent by registered mail to the teacher's most recent certification. Upon request of the Association President, each subsequent October 1, additions, deletions and corrections to the list will be provided by last known address on file with the Board.
6C. All compensation shall cease when the teacher is reduced pursuant to the reduction in personnel. Employees on layoff do not acquire seniority while on layoff but seniority before layoff The teacher shall be reinstated when paid all compensation which has been earned up to the date of reduction. The teacher shall be maintained as a member of the employee is rehiredgroup for purposes of the reduced teacher continuing health insurance coverage at the group premium rate under COBRA for a period of up to eighteen (18) months after reduction, subject to the permission of the health insurance carrier. The teacher shall submit the required payment to the school district in advance of the district's scheduled payment date to the insurance carrier.
7. Substitute teachers D. Teachers who have attained tenure in the Mio AuSable Schools and other temporary teachers do not acquire seniority but contracted teachers will acquire seniority prorated are reduced pursuant to a reduction in personnel shall be recalled to the amount of time employed.
8. Teachers displaced by a layoff or the elimination of a first position may bump for positions if they are certified and qualified (certified in a particular subject area or grade) and have more seniority. This must be done in writing to the Superintendent within five (5) days after receipt of notice of displacement. If a displaced teacher is certified but not qualified to bump any junior teacher, the displaced teacher may bump the teacher with the least seniority assigned to a position for which the displaced teacher is certified provided:
(a) The displaced teacher has more seniority.
(b) The displaced teacher shall have the opportunity to become certified and qualified prior to the start of the position.
(c) The displaced teacher will have two (2) years to become certified and qualified. The Board shall reimburse the displaced teacher for 100% of the actual cost of the tuition for the courses required for qualification.
9. Seniority will be defined as continuous service as a teacher with Grass Lake Community Schools, starting with the individual's date of hire.
10. Recall from layoff shall be in inverse order of layoff for positions for which the teacher is certified and qualified. No new teachers shall be employed by the Board while there are teachers qualified in order of the District laid off who are certified and qualified to fill the vacancy.

Notice of recall shall be sent by certified mail, return receipt requested, to any laid off teacher may be by telephone if the teacher can be reached, teacher's last known address on file with a confirmation by mail sent immediately thereafter by the Board. 12. The recall list E. Nothing in this article shall be maintained for supersede rights of a period of two (2) years for non- tenure teachers. Tenure teachers will remain on the recall list as provided tenured teacher under the Michigan Teachers' Tenure Act.
13. Teachers on lay-off may, at their option, reimburse the District to continue their fringe benefits for one (1) year. Timely payment of this reimbursement is the responsibility of the teacher.
