PERSONNEL REDUCTION. Section 1. In the case of a personnel reduction, probationary employees in the classification to be reduced shall be laid off first. Thereafter, the employee in the classification to be reduced with the least seniority shall be laid off first. Battalion Chiefs with the least seniority in the rank of Battalion Chief shall be reduced to the highest rank they previously held and are currently qualified for or may become qualified for within three (3) months or such extension of time as may be agreed to by the Fire Rescue Administrator and the Union President. For purposes of this Article, employees who have a needs improvement or unacceptable performance evaluation during the most recent annual evaluation may have their seniority reduced by one year. For purposes of this Article, assigned Paramedics shall be considered a classification only in order to prevent the number of Paramedics from being reduced below State requirements.
Section 2. Employees who are laid off from their classifications may bump into the next lower classification in which case they may bump the most junior employee in the classification if that junior employee has less seniority.
Section 3. Employees who are laid off, or who have bumped into the next lower classification, shall be recalled to their original classification in the reverse order in which they were laid off or bumped (last laid off or bumped, first recalled) provided they meet the requirements to perform the work. Employees on layoff or who have been bumped, shall be offered recall before employees are hired into their classification, or shall be offered a new position in another lateral or lower classification for which they are qualified before new employees are hired into the other classification.
Section 4. Employees who are laid off shall be paid one hundred (100%) percent of accrued vacation leave.
Section 5. In the case of a personnel reduction in the rank of District Chief, those District Chief(s) identified by the Fire Rescue Administrator who were promoted to that rank before July 14, 2000, and District Chiefs appointed to the rank as a result of municipal mergers, shall be reduced to the rank of Battalion Chief. PERSONNEL REDUCTION. Section 1 In the event of layoffs in connection with decreasing the work force, and the recall to work of people so laid off, the following consideration shall govern. Skill and ability as determined by reference to the employee's work record, and length of service shall be the determining factors; however, employees shall be laid off by category of seniority. There shall be three (3) seniority categories: probationary, 1 yearto 5 years seniority, and over 5 years seniority. In case of layoff, all employees in the lowest seniority category shall be laid off before proceeding to layoff of anyone in a more senior category. Where skill and ability within a category are approximately equal, length of service shall govern. Employees having the same seniority within a category shall draw lots to determine the order of layoff. No new employees shall be hired until all laid off employees have been given the opportunity to be re-hired. Employees who have been laid off will be offered re-employment in the inverse order of layoffs when they are needed again, provided they are physically qualified and possess sufficient training and experience to perform the duties of the available work. The City shall give laid off employees ten (10) days notice of its intention to rehire. The employees shall within ten (10) days period notify the City of their intention to, or not to, return to the employ of the City, and shall report to work no later than fifteen (15) days from receipt of said notice to rehire. If an employee fails to notify the City within the ten (10) calendar day period of his/her intentions to return to work, or fails to report to work within fifteen (15) calendar days from the date of notice, he/she shall be considered permanently severed from the employ of the City. At the time of a layoff the City shall provide all laid off employees with a complete physical examination. At the time of rehire, the City may require a physical examination prior to the employee's return to duty, and it is expressly understood that any employee found physically unfit to return to duty may be refused re-employment and removed from the employment list. The City shall not be obligated to rehire laid off employees who have been laid off for five (5) or more consecutive calendar years, beginning from the date of layoff.

PERSONNEL REDUCTION. Section 26.1 In the case of a personnel reduction, the Employee with the least seniority shall be laid off first. Seniority within the same graduating class shall be determined by the ROIC number. Time with the Tulsa Fire Department shall be given the utmost consideration.
Section 26.2 No new Employees shall be hired until the Employee or Employees laid off and Union have been notified that an opening exists by registered mail. Within fifteen (15) days after receipt of such notification, Employee or Employees on layoff will notify the Chief of the Fire Department of their intention. The Employee's failure to respond within the fifteen (15) days provided shall be considered as indication that the Employee does not intend to continue his employment with the Tulsa Fire Department.
PERSONNEL REDUCTION. Reduction in Force: A reduction in the number of employee positions by a school board, accomplished either by attrition, non-renewal, change of job description, layoff, or if a position is vacated and not re-filled.

PERSONNEL REDUCTION. A. The City and the Union agree that a reduction in force of personnel, as it pertains to employees in positions of an indefinite duration which are abolished and which are covered by the provisions of this Agreement, shall be as follows:
1. Competition for retention shall be limited to employees holding positions in those classifications.
2. Competition for retention in employment in classification and position shall be based on seniority of service within that classification and position with the City. The order of reduction in force within a classification shall be:
a. Temporary employees
b. Probationary employees
c. Regular employees in reverse order of their seniority within a classification
3. All personnel who are affected by a reduction in force shall have the right to receive a reduction in classification and position to a lower classification/position that they are qualified to fill through previous service in that classification/position.
4. All personnel involved in a reduction in a classification and position shall have the opportunity to return to the position from which the employee was reduced before any other person shall be promoted to that position in that same classification and position.
5. Any employee terminated under the provisions of this Article shall have the opportunity to return to work before any new employee is hired. Previous employees shall be notified via email and telephone and shall respond within fourteen (14) calendar days of notification via email or in person that they are accepting the offer of re-employment on the date specified in the offer. Employees will remain on the rehire list for thirty-six (36) months from the date of the employees' layoff.
PERSONNEL REDUCTION. In the event that Layoffs should become necessary, the employee(s) with the least seniority shall be laid off first. Employees shall be recalled in the order of their seniority. Time in the bargaining unit shall constitute total seniority. No new employees shall be hired until all laid-off employees have been given ample opportunity to return to work.
PERSONNEL REDUCTION. The City, in its discretion, shall determine whether layoffs are necessary. In case of a personnel reduction, the Employer shall follow the procedures set forth by Illinois statute (65 ILCS 5/10 - 2.1-1 et seq.) and as administered by the Board of Police and Fire Commission Rules and Regulations.
PERSONNEL REDUCTION. Section 1: In the case of personnel reduction, the employee with the least amount of Fire Dept. seniority shall be laid off first. No new employee shall be hired until the laid off employee has been given the opportunity to return to work.
a) Employee laid off must maintain his current mailing address with the Fire Chief.
b) Employee laid off must be given the opportunity to return to work and must reply within thirty (30) days after receipt of certified mail.
c) In order to maintain his/her recall rights, a laid-off employee must maintain their licenses, which he/she held when laid-off. As allowed by law, the City will continue to be a sponsoring agency to allow these employees to receive training in order to maintain their licenses.
PERSONNEL REDUCTION. In case of layoff or rehiring, employees with the longest seniority shall be laid off last and rehired first. If an employee is laid off, the employee shall retain seniority for twelve (12) months from date of layoff. Any Command or Supervisory Personnel who return to the rank of Patrol Officer as a result of personnel reduction shall have seniority determined by the length of full time service in the South Portland Police Department.
