REDUNDANCIES AND TRANSFER OF BUSINESS. Within the year ending on the date of this agreement the Company has not: 32.4.1 given notice of redundancies to the relevant Secretary of State or started consultations with a trade union under Chapter II of Part IV of the Trade Union and Labour Relations (Consolidation) Xxx 0000 or failed to comply with its obligations under Chapter II of Part IV of that Act; or 32.4.2 been a party to a relevant transfer (as defined in the Transfer of Undertakings (Protection of Employment) Regulations 2006) or failed to comply with a duty to inform and consult employee representatives or a trade union under those Regulations.

REDUNDANCIES AND TRANSFER OF BUSINESS. In the 12 months preceding the date of this Agreement, the Company has not:- 7.6.1 given notice of redundancies to the relevant Secretary of State or started consultations with a trades union under Chapter II of Part IV of the Trade Union and Labour Relations (Consolidation) Xxx 0000 or failed to comply with its obligations under Chapter II of Part IV of that Act; or 7.6.2 been a party to a relevant transfer (as defined in the Transfer of Undertakings (Protection of Employment) Regulations 1981) or failed to comply with a duty to inform and consult a trade union under those Regulations.
REDUNDANCIES AND TRANSFER OF BUSINESS. Within the period of one year ending on the date of this Agreement, no Acquired Company has: (a) given notice of any redundancies to its employees and/or the Minister for Enterprise, Trade and Employment or started consultations in respect of redundancies with any trade union or directly with employees and/or their representatives whether pursuant to Part II of the Protection of Employment Act, 1977 and 2000 or Regulation 7 of the European Communities (Safeguarding of Employees’ Rights on Transfer of Undertakings) Regulations 1980 and 2000 or otherwise; and (b) been a party to any relevant transfer within the scope of the European Communities (Safeguarding of Employees’ Rights on Transfer of Undertakings) Regulations, 1980 and 2000 nor has any Acquired Companies member failed to comply with any duty to inform and consult any trade union under those Regulations.
