Releasees. The term “Releasees” includes: the Company, the Partnership, and any and all of their respective direct or indirect parent, subsidiary, related and/ or affiliated companies, and each of their past and present employees, officers, directors, attorneys, owners, shareholders, members, managers, partners, insurers, benefit plan fiduciaries and agents, and all of their respective successors and assigns.
Releasees. Executive agrees that this Separation and Release Agreement and the enclosed Employment Agreement releases all claims and potential claims against the Company, BHI, and any affiliated companies and related business entities, as well as their shareholders, subsidiaries, parent companies, divisions, joint ventures, sister corporations, assigns, assets, agents, employee benefit and/or pension plans or funds (including qualified and non-qualified plans or funds), employee benefit plan fiduciaries, insurers of employee benefits, directors, officers, former officers, employees, members, administrators, attorneys, representative trustees, successors/heirs, any co-employers or joint employers, and as intended third-party beneficiaries, investors, lenders, contractors, and all persons acting by, through, under, or in concert with them, jointly and severally, in their individual, fiduciary, and corporate capacities (collectively referred to throughout this Separation and Release Agreement and the enclosed Employment Agreement as the “Releasees”).

For purposes of this Agreement, the term “Releasees” includes the Company and the Company’s parents, subsidiaries, affiliates, related companies, partnerships and joint ventures, predecessors, successors and assigns, and with respect to each such entity, all of its past and present employees, officers, directors, shareholders, owners, representatives, agents, attorneys, assigns, insurers, employee benefits plans and such plans’ administrators, fiduciaries, trustees, assigns and agents, and each of its and their respective successors and assigns, each and all of them in their personal and representative capacities, and any other persons or entities acting on behalf of any of these persons or entities.

For purposes of this document (the “Release”), I understand that “WSU” or “University” refers to Wichita State University and its employees, students, agents, servants, officers, trustees, and representatives (in their official and individual capacities) (hereinafter, collectively the “Releasees”).

RELEASE: IN CONSIDERATION FOR FACILITATING MY PARTICIPATION IN THE ACTIVITY DESCRIBED ABOVE (HEREAFTER ACTIVITY), I RELEASE, DISCHARGE, AND AGREE NOT TO SUE RELEASEES FOR ANY CLAIMS, DEMANDS, ACTIONS, AND CAUSES OF ACTION OF ANY NATURE WHATSOEVER INCLUDING A CLAIM OF NEGLIGENCE, ARISING OUT OF ANY LOSS OR DAMAGE TO MY PROPERTY AND ANY INJURY, INCLUDING DEATH, THAT I MAY SUSTAIN WHETHER OR NOT CAUSED BY THE NEGLIGENCE OF THE RELEASEES, WHILE PARTICIPATING IN THE ACTIVITY, SUPERVISED OR UNSUPERVISED, OR WHILE IN TRANSPORTATION TO AND FROM THE ACTIVITY. 3. Risks: To the best of my knowledge, I am in good health and have no physical limitations that would preclude or impede my participation in this Activity. I am aware of the risks and hazards connected with the Activity, and I elect to participate voluntarily and engage in this Activity knowing that the Activity may be hazardous to my property and me. I voluntarily and expressly agree and promise that I assume full responsibility for property loss or damage, and for personal injury, including death, that I may sustain as a result of being engaged in this Activity, whether or not based on the negligence or other wrongful conduct of Releasees. 4.
Releasees. For purposes of this Agreement, “Releasees” include Xxxxxx and its affiliated companies and their officers, directors, shareholders, employees, agents, representatives, plans, trusts, administrators, fiduciaries, insurance companies, successors, and assigns.

Releasees means the Company; the present or former directors, members, officers, shareholders, employees, affiliates, agents and advisors (including attorneys) of each entity constituting the Company; and the current or former trustees or administrators of any pension or other benefit plan applicable to the employees or former employees of any of the entities constituting the Company.
