Remediation Requirements. The Purchaser agrees that any remediation performed by the Purchaser or the Vendor shall be consistent with the industrial use of the Owned Properties and shall make maximum benefit, to the extent commercially reasonable to do so, of institutional controls, engineering controls and natural remediation pursuant to Environmental Laws in order to minimize investigation and remediation costs to the extent feasible.

Remediation Requirements. Prior to the Execution Date Buyer ------------------------ began its investigation and analysis of the remediation requirements applicable to the Real Property and the Adjacent Property and shall continue to use diligent efforts to determine, at Buyer's sole expense, the remediation requirements applicable to the Real Property and the Adjacent Property. Without limiting the foregoing, Buyer shall review all Environmental Laws applicable to the Real Property and the Adjacent Property. Buyer and its consultants/representatives shall be permitted to independently contact governmental agencies to discuss Buyer's remediation plans for the Real Property. Buyer shall give Seller forty-eight (48) hours' written notice of any proposed meetings or any proposed telephone conferences and Seller shall have the right to be present at any such meetings or on any such telephone conferences.

Remediation Requirements. Customer shall have the right to take reasonable and appropriate steps to (i) verify that SMA Technologies uses the Personal Data that SMA Technologies receives from, or on behalf of, Customer in a manner consistent with this DPA so that Customer can meet its obligations under Data Protection Law. This right may encompass performing audits in accordance with this DPA; (ii) stopping and remediating SMA Technologies’ unauthorized use of Personal Data; and (iii) taking any such other remediation efforts reasonably agreed upon by the parties. By way of example, and in accordance with the Agreement, Customer may require SMA Technologies to provide documentation that verifies that SMA Technologies no longer retains or uses Personal Data of Data Subjects who have made a valid request of Customer to delete their Personal Data.
