RENEWAL OF EMPLOYMENT AGREEMENT. Upon the occurrence of the Extension Date, the term of the Employment Agreement shall be extended through the Extended Employment Period, as modified by this Agreement. Thereafter, the term of the Employment Agreement will be automatically extended for 12-month periods, unless not later than three months before the last day of the term of the Employment Agreement, the Company or the Executive shall have given written notice to the other of its intention not to extend this Agreement and the Employment Agreement, or unless the Employment Agreement is earlier terminated in accordance with its terms. The Company may not provide a notice of non-renewal of the Employment Agreement without simultaneously providing a notice of non-renewal of this Agreement. If there is a conflict between the Employment Agreement and this Agreement, this Agreement shall supersede the Employment Agreement, provided that the Executive shall receive the more valuable payment, right or benefit under the Employment Agreement (including without limitation, the continuation of medical benefits under the Employment Agreement) and this Agreement. In no event shall any payment, right or benefit under the Employment Agreement be reduced, eliminated or otherwise adversely affected by this Agreement. In no event shall the Executive receive any payment, right or benefit under both this Agreement and the Employment Agreement with respect to the same date of termination of employment with the Company.
RENEWAL OF EMPLOYMENT AGREEMENT. The Board will notify the Superintendent in writing by February 1, 2025 if there is intent to nonrenew; otherwise, the employment agreement will be renewed for an additional two (2) year period beginning July 1, 2025. In the absence of a written nonrenewal, this Agreement shall automatically renew at the end of its term, or when a successor is appointed, whichever occurs first. It is expressly agreed and understood by all parties that the Superintendent has no expectation of continued employment beyond the term of this agreement.
RENEWAL OF EMPLOYMENT AGREEMENT. In accordance with Section 1073 of the School Code, the Board may act during the last year of Superintendent’s term to reappoint Superintendent to a new term or to appoint another person as Superintendent thereafter. The Board must notify Superintendent no later than ninety (90) days prior to the expiration date of this Agreement of the Board’s intent whether or not to reappoint Superintendent. Should the Board fail to so notify the Superintendent, Superintendent shall be deemed to be appointed for an additional Term of one (1) year, and the terms and conditions of this Agreement shall be incorporated into a successor contract unless mutually agreed otherwise by the Board and the Superintendent.
RENEWAL OF EMPLOYMENT AGREEMENT. Any renewal of this Contract shall be in accordance with the provisions of Maryland statutory law.
RENEWAL OF EMPLOYMENT AGREEMENT. The Board will annually consider the renewal of this Agreement for a new two-year term. For avoidance of doubt, before June 15 of the first year of the term, the Board will consider the renewal of the Superintendent’s employment agreement for a new two-year term commencing July 1. Any such renewal will be memorialized in a written agreement approved by the Board in an open meeting. In the event the Board does not renew this Agreement during year one of its term and elects not to renew the contract at the end of its original two-year term, it shall provide Superintendent with written notice of same no later than February 1 of the year in which the two-year term expires. In the absence of a written renewal extending the term, this Agreement shall automatically expire at the end of term set forth in paragraph 1 above, or when a successor is appointed, whichever occurs first. It is expressly agreed and understood by all parties that the Superintendent has no expectation of continued employment beyond the term of this Agreement.

In addition, the terms of this Section 6 shall remain in full force and effect whether or not Executive dies or suffers a Disability pursuant to the terms hereof during the Consulting Period. Further, if at any time during the Term of this Agreement Executive shall elect, at his sole option, to cease being a full time employee, then and in that event, Executive shall become a consultant pursuant to the terms of this Section. During the Consulting Period, Executive shall have the right to the same benefits for the same purposes and to the same extent as were in effect during the term of this Agreement, provided, however, if Executive ceases to be the Executive Chairman, Executive shall no longer receive Deferred Compensation. The Consulting Services to be provided shall be commensurate with Executive’s training, background, experience and prior duties with the Company Executive shall receive such stock options or cash bonuses as the Compensation Committee, in its sole discretion shall determine. Executive agrees to make himself reasonably available to provide such Consulting Services during the Consulting Period; provided, however, the Company agrees that it shall provide reasonable advance notice to Executive of its expected consulting needs and any request for Consulting Services hereunder shall not unreasonably interfere with Executive’s other business activities and personal affairs as determined in good faith by Executive. In addition, Executive shall not be required to perform any requested Consulting Services which, in Executive’s good faith opinion, would cause Executive to breach any fiduciary duty or contractual obligation Executive may have to another employer. Further, during the Consulting Period, Executive shall not be subject to any non-competition provisions except for the two-year period provided for in Section 5(c). Unless waived by Executive, Executive shall not be required to perform Consulting Services for more than four (4) days during any week or for more than eight (8) hours during any day. Executive’s travel time shall constitute hours of Consulting Services for purposes of this Section 6. The Parties contemplate that, when appropriate, the Consulting Services shall be performed at Executive’s office or residence and at the Company’s executive offices in Houston, Texas and may be performed at such other locations only as they may mutually agree upon. Executive shall be properly reimbursed for all travel and other expenses reasonably incurred by Executive in rendering the Consulting Services.

  • CONTRACT OF EMPLOYMENT 22.1 At the point of engagement of each Employee, the Employer must inform the person in writing whether the engagement is on a permanent, casual or job share basis, stating by whom the Employee is employed, the job performed, the classification level, office from which they are engaged and the relevant rate of pay. Employees may relocate and transfer their office of engagement provided that there has been consultation between the Parties and it is agreed in writing between the Employer and the Employee. Each new Employee shall upon commencement also be provided with a copy of this Agreement, or alternatively, access to the Agreement in electronic format at the discretion of the Employee. 22.2 The Employer may direct an Employee to carry out such duties as are reasonably within the limits of the Employee's skill, competence and training consistent with the Employee's classification provided that such duties do not promote deskilling. 22.3 If an Employee is absent from work for a period for which they have or will claim workers' compensation, the Employee's contract of employment shall remain intact during the period of absence. The Employer shall continue to make contributions (and where applicable, reports of service) on behalf of the Employee to BUSSQ, XXXX, BEWT, CIPQ and Qleave or NTBuild or other funds nominated herein. The Employee shall also continue to accrue all appropriate leave entitlements for the first twelve months of the Employee's absence due to the workers compensation claim.
