Renewal Subscription Fee. The Subscription Fee applicable to each Renewal Term shall be the then-current list price of the Performance Level that corresponds to the average BPU usage during the three months prior to the date the Renewal BPU Report is generated by Bizagi. In order to determine Customer’s average BPU usage and corresponding Subscription Fee, prior to the expiration of the immediately preceding Subscription Term, Bizagi will generate a report (“Renewal BPU Report”) showing Customer’s BPU usage for the three months immediately preceding the date the Renewal BPU Report is generated.

Renewal Subscription Fee. Partner shall pay a Renewal Subscription Fee within thirty (30) days of the start of the Renewal Subscription Term (a “Renewal Subscription Fee”), unless other payment terms are stated in the Order Form. Renewal Fee Calculation: Partner’s Renewal Subscription Fee will be determined using the pricing tiers and guidelines as set forth in the Order Form. Based on the pricing table and the number of Student User Applications Received, the new Renewal Subscription Fee for the subsequent Subscription Term will be adjusted, except that for any Subscription Term, the subsequent annual Subscription Fee shall not decrease. If Partner provides Partner Statistics for the Subscription Term in a timely manner (as required), the subsequent annual Subscription Fee increase shall be limited to a maximum of two tiers above the current Subscription Fee Tier, unless otherwise agreed upon in writing.

Each Red Hat Storage Server Subscription includes one Software Subscription to Red Hat Enterprise Linux Server and the Scalable File System Add-on, which are supported solely in connection with the use of Red Hat Storage Server.   • Early Termination Fee After this contract goes into effect, if you terminate this contract for any reason, or switch your service to a different electricity generation supplier or default service supplier prior to the end of the contract term, you will be responsible for paying XOOM Energy an early termination fee in the amount of $500. This Early Termination Fee is intended not as a penalty, but simply to offset the cost of selling the unused portion of your electric power to others and estimated lost revenue that XOOM may incur from such a sale, if any, and related expenses.
