Rental and Other Payments. A. If the Effective Date is a date other than the first day of the month, Lessee shall pay Lessor on the Effective Date the Base Monthly Rental prorated on the basis of the ratio that the number of days from the Effective Date through the last day in the month containing the Effective Date bears to the number of days in such month. Thereafter, on or before the first day of each succeeding calendar month, Lessee shall pay Lessor in advance the Base Monthly Rental. B. All sums of money required to be paid by Lessee under this Lease which are not specifically referred to as rent ("Additional Rental") shall be considered rent although not specifically designated as such. Lessor shall have the same remedies for nonpayment of Additional Rental as those provided herein for the nonpayment of Base Annual Rental.

(i) Lessor hereby agrees that, to the extent that the Aggregate Assumed Base Annual Rental exceeds the CPI-Adjusted Rent, Lessor shall be required to pay Lessee the Aggregate Rent Refund in accordance with the provisions of this Section 5.D. In no event shall Base Annual Rental be deemed reduced as of any Adjustment Date from the Base Annual Rental which would have been payable during the year immediately preceding such Adjustment Date. In addition, if the Aggregate Assumed Base Annual Rental is less than or equal to the aggregate CPI-Adjusted Rent, then no additional amounts shall be payable by Lessee to Lessor and the payments of Base Annual Rental otherwise contemplated by this Lease for the Primary Term shall become the final amounts payable as Base Annual Rental for the Primary Term. Anything contained herein to the contrary notwithstanding, in no event shall Lessor be required to pay the Aggregate Rent Refund in the event of any termination of this Lease resulting from the occurrence of an Event of Default or a rejection of this Lease in a bankruptcy case involving Lessee. Rental and Other Payments. (a) The start of the lease term is the date on which DSMBI substantially completes its scope of work for installation, unless otherwise agreed to among the parties. Monthly rental will accrue through and including the month in which the later of the Return Date or End of the Term occurs. The “Return Date” is the date on which the Equipment is returned to DSMBI in accordance with the terms of this Lease. The “End of the Term” is the date on which the term of this Lease is to expire either originally, under a renewal term or under month-to month renewals as contemplated by this Lease, Rental and such other charges will be prorated on a daily basis where necessary. Unless other wise specified in this Lease, charges for delivery and installation, initial month’s rent and any applicable initial charges as outlined on the front of this agreement will be due and payable at the start of the lease term, and charges for teardown and return will be due and payable at the earlier of the Return Date or the End of Term. After payment of the initial month’s rent, each month’s rent thereafter is due and payable without demand and in advance (i) at the end of each thirty (30) day period following the commencement of the lease term, if a rental month is defined on the first page of this Lease as a thirty-day period or (ii) on the first of each month immediately following the month in which this lease commences, if a rental month is defined on the first page of this Lease as a calendar month. All other sums payable by Customer under this Lease are due and payable when invoiced. Unless agreed otherwise, all payments made under this Lease will be made by Customer’s check drawn on its regular bank checking account or such other form of payment as is acceptable to DSMBI. All payments by Customer will be made without setoff or deduction of any kind. (b) Customer will pay DSMBI for any and all sales and use taxes, other direct taxes and registration fees imposed by any city, county, state, or federal government or other taxing authorities and related directly or indirectly to the Equipment or its use, excluding federal or state taxes relating to income (all of the foregoing that Customer is to pay, “Taxes”). Rental and Other Payments. A. Tenant shall pay to Landlord during the Term rental of $69,568.00 per year, payable in installments of $5,797.33 per month commencing on July 1, 2011. Such rent represents Landlord’s Basic Rent of $69,568.00 per annum ($5,797,33/month) under the Master Lease. Each installment payment shall be due in advance on the first day of each calendar month during the lease term to Landlord at 0000 Xxxxxxx Xxxxx Parkway, Everett WA 98203 or at such other place designated by written notice from Landlord or Tenant. The rental payment amount for any partial calendar months included in the lease term shall be prorated on a daily basis. B. Tenant shall also pay Landlord any and all. Rental and Other Payments. (a) You must pay us the rental payments in the amount and frequency as set out in the Schedule. (b) When we deliver the goods to you, you must pay us the first rental payment in advance. The next rental payment will be deducted under the Direct Debit Services Agreement. (c) Rental payments are made in advance. (d) If you fail to pay us a rental payment as set out in the schedule you will be in breach of this Agreement. (e) Rental payments must be paid in clear fund without any deductions, set off or counterclaims. You are not entitled to deduct any monies that you may claim are payable to you by us from the rental payments. (f) You obligation to pay the rental payment is unconditional and irrevocable. (g) The rental payments are fixed. If there are any government charges or taxes that apply to this Agreement, you must pay us the government charge or tax unless the tax relates to our income. (h) If you are in breach of your obligations under this Agreement, we may charge you a late payment fee as set out in the Schedule. The late payment fee includes any fee we pay to our banker on account of a dishonoured payment as well as internal administration fee. You will be liable to pay us the late payment fee until the default is remedied or the Agreement is terminated and the Goods are returned to us in good working order.
