Repayment of Assistance. If in the reasonable opinion of the Department the Company fails to meet any of the Performance Criteria in whole or in part, the Company must repay to the Department the whole or any part of the Assistance previously paid to the Company having regard to the nature and extent of the Company’s non-compliance, together with interest calculated in accordance with the daily published Commonwealth Bank of Australia corporate overdraft reference rate as demanded by the Department within 28 days of the Department serving notice of demand under this clause upon the Company.

Repayment of Assistance. Failure to comply with the Job Requirement and the Qualifying Job Requirements as set forth herein may result in a requirement for repayment by the Company of all or a portion of the CDBG funds received. The Company will make re-payments to the Grantee, who will immediately notify and reimburse Commerce.
Repayment of Assistance. No repayment is required if you occupy the premises as your principal residence throughout the POA. However, full or partial repayment will be required under the following conditions: a. If you fail to comply with the provisions of this agreement and the lien for the duration of the POA, HOME Assistance must be repaid to the HTFC. b. Upon sale of the Premises with no assumption of the HOME Assistance as set forth below, whether voluntary or involuntary, the amount recaptured by HTFC from you will be the prorated amount of the HOME investment and shall not exceed the amount of net proceeds you receive from the sale. Net proceeds are equal to the sales price of the Premises minus any superior loan repayment, other than HOME funds, and any closing costs.

  • Plan of Assistance The Plan of Assistance is designed to be helpful. It is initiated when other means of the assistive process have not been successful and the supervisor determines that the classified employee needs additional assistance and support to maintain or achieve an acceptable level of performance.

  • Structure of Assistance The Program is envisioned as a revolving fund. The Program will make a five-year, non-recourse, zero-percent forgivable, non- amortizing loan in which a second lien is recorded on the property. Twenty percent of the loan will be forgiven for each year the loan is outstanding. If the property is sold or refinanced prior to the loan termination date, the Program will recover funds should sufficient equity be available from the transaction. The Program will recycle recovered funds in order to provide additional program assistance until December 31, 2017, at which time any recovered funds will be returned to Treasury.

  • Prohibition of Assignment This Agreement and the rights, duties and obligations hereunder may not be assigned or delegated by Consultant without the prior written consent of the Company. Any assignment of rights or delegation of duties or obligations hereunder made without such prior written consent shall be void and of no effect.

  • PROVISION OF FINANCIAL ASSISTANCE As authorized by Section II of this Agreement for the sole and express purpose of financing the Project defined and described in Appendix A of this Agreement, the estimated costs of which are set forth and described in Appendix D of this Agreement, the OPWC hereby agrees to provide financial assistance, subject to the terms and conditions contained in this Agreement, from the State Capital Improvements Fund which constitutes the proceeds of the Infrastructure Bonds, in an amount not to exceed One Hundred Ninety-Nine Thousand, One Hundred Seventy-Nine Dollars ($199,179). This financial assistance shall be provided in the form of a Grant. The OPWC Grant Control No. is CJ23U.

  • PROVISION OF FINANCIAL ASSISTANCE GRANT As authorized by Section II of this Agreement for the sole and express purpose of financing the Project defined and described in Appendix A of this Agreement, the estimated costs of which are set forth and described in Appendix D of this Agreement, the OPWC hereby agrees to provide financial assistance, subject to the terms and conditions contained in this Agreement, from the State Capital Improvements Fund which constitutes the proceeds of the Infrastructure Bonds, in an amount not to exceed Seven Hundred Forty-One Thousand, Three Hundred Seventy-Four Dollars ($741,374). This financial assistance shall be provided in the form of a Grant. The OPWC Grant Control No. is CK17V.

  • Notification of Assignment Any assignment that is not undertaken in accordance with the provisions set forth above shall be null and void ab initio. A Party making any assignment shall promptly notify the other Party of such assignment, regardless of whether consent is required. This Agreement shall be binding upon and inure to the benefit of the Parties hereto and their respective successors and permitted assigns.

  • Termination of Assignment Citizens and the Firm may each terminate a specific assignment or all assignments held by the Firm, at any time upon advanced written notice. Citizens may also reassign any matter at any time upon advanced written notice.

  • DURATION OF ASSIGNMENT The scope of services of this Assignment shall be completed no later than August 31, 2023, unless terminated earlier as provided in Section 3.2 of the Agreement. The schedule is subject to adjustments for possible time extension; however, any extension of time must be approved by the TFC and shall require an amendment to Assignment No. 1.
