Reports by Tenant. Tenant shall furnish to Landlord within thirty (30) days after the expiration of each Lease Year a complete statement (“annual report”), certified by an officer of Tenant, of the amount of Gross Sales, as defined in Article II, Section 2.03 of this Lease, made in, on or from the Leased Premises during said period. Failure of Tenant to timely submit annual reports as aforesaid shall entitle Landlord to estimate Gross Sales based upon available data (with a reconciliation upon receipt of the annual report), and Tenant shall be obligated to pay percentage rent, as set forth in Section 2.02, on such estimated Gross Sales. Tenant shall furnish to Landlord within five (5)ten (10) days after the end of each month of the term of this Lease a written statement of Gross Sales covering the preceding month, the statement to be in such form and style and contain such details and breakdown as Landlord may reasonably require. Tenant shall require and cause all its concessionaires, if any, to furnish statements at the times and in the form and content specified in this Section, relating to their operations within the Leased Premises. All reports of Gross Sales submitted or caused to be submitted by Tenant to Landlord shall be conclusive and binding upon Tenant unless such reports are corrected within two (2) years after the date of issuance. The term “concessionaire” as used in this Lease shall mean and include any and all concessionaires, licensees, franchisees, department operators, subtenants, permittees or others directly or indirectly operating or conducting a business in or from the Leased Premises. In addition to all other rights and remedies available to Landlord, Tenant shall pay to Landlord FiveTwo Hundred and 00/100ths Dollars ($500.00200.00) for each failure to timely provide any required report in order to partially compensate Landlord for the administrative costs and other damages arising from Tenant’s failure to comply with this Section. Such amount shall be immediately due and payable as additional rent under this Lease. Reports by Tenant. Tenant shall submit to Landlord on or before the sixtieth (60th) day following each lease year during the Term hereof at the place then fixed for the payment of rent, or at such other place designated by Landlord, a written statement signed by Tenant, and certified by it to be true and correct, showing in reasonable, accurate detail, the amount of Gross Receipts for each preceding year. Tenant shall submit to Landlord on or before the sixtieth (60th) day following the end of each lease year at the place then fixed for the payment of rent, a written statement signed by Tenant, and certified to be true and correct showing in reasonably accurate detail satisfactory in scope to Landlord, the amount of Gross Receipts during the preceding calendar year. At Landlord’s option, the written statement shall be duly certified to Tenant and Landlord by independent certified public accounts of recognized standing. The accounting statement referred to in this Section 6.02 shall be in such form and style and contain such details and breakdown as the Landlord may reasonably require. If Tenant fails to timely submit to Landlord either the monthly or annual written statement described in this Section 6.02, Tenant shall pay to Landlord, as additional rent and without limiting any other remedy Landlord may have against Tenant under this lease as a result of this breach, a $100.00 (increased each year according to the Index) charge for each and every month that the Tenant fails to timely submit such written statement. Alternatively, Landlord shall have the right, upon five (5) days written notice, to audit Tenant’s records at Tenant’s expense.
Reports by Tenant. Upon request by Landlord at any time after 135 ----------------- days after the end of the applicable fiscal year of Tenant, Tenant shall deliver to Landlord (within 15 days after receipt of written request) a copy of the audited financial statement of any guarantor of Tenant's obligations under this Lease. If such audited statements are not available, Tenant may provide such statements certified by such guarantor's chief financial officer as being true and correct, in accordance with generally accepted principals of accounting consistently applied over the applicable periods. Said financial statements shall only be required in connection with a proposed sale or mortgaging of the Demised Premises and shall be held in confidence by Landlord and any such proposed purchaser or lender or their respective successors or assigns. Notwithstanding the foregoing, Tenant shall cause First Data Corporation to submit annual audited financial statements to Landlord and Landlord's mortgagee in the manner set forth herein if First Data Corporation ceases to be a publicly traded company.

Within thirty (30) days after the 52 end of each lease year, Tenant shall deliver to Landlord a written statement signed by a certified public 53 accountant, or an officer of Tenant, setting forth the amount of Tenant's Gross Sales for such lease year
Reports by Tenant. Tenant shall furnish to Landlord within fifteen (15) days after the expiration of each month of each lease year a complete statement, certified by an officer of Tenant, of the amount of Gross Sales made in, on or from the leased premises during said month. Tenant shall also furnish to Landlord within thirty (30) days after the expiration of each lease year a complete statement, certified by an independent certified public accountant employed by Tenant, or by Tenant's financial officer (if Tenant is a publicly traded corporation), showing in all reasonable detail the amount of Gross Sales made by Tenant in, on or from the leased premises during such lease year. Tenant shall cause and require all of its concessionaires or subtenants, if any, to furnish statements at the times and in the form required herein relating to their operations within the leased premises. All Gross Sales statements to be supplied by Tenant to Landlord shall be in such form and with such detail as Landlord shall reasonably deem necessary.
Reports by Tenant. On or before the tenth (10th) day of each month, Tenant shall submit to Landlord, at the address specified in this Agreement, a written statement certified by Tenant showing Xxxxxx's Gross Sales for the preceding calendar month (the “Monthly Gross Sales Statement”). Within thirty (30) days after the end of each lease year, Tenant shall deliver to Landlord a written statement signed by a certified public accountant, or an officer of Tenant, setting forth the amount of Tenant's Gross Sales for such lease year (the “Annual Gross Sales Statement”). In the event that Tenant fails to furnish to Landlord any Monthly or Annual Gross Sales Statement when due, Landlord, in addition to any other rights and remedies that Landlord may have under this Agreement, or at law or in equity, shall be entitled to assess an administrative charge of $250.00 for each such delinquent Gross Sales Statement to help defray additional expenses.
