Restrictions on Usage. A. Tenant covenants and agrees that during the term of this Lease neither Tenant, assignee nor any subtenant (if the same are permitted pursuant to this Lease) will use as its name or as part of its name (under which it conducts business) any name which, regardless of the spelling thereof, has the same or similar sound or meaning as the words “MEDICAL CENTER”, “MEDICAL GROUP” or “MEDICAL TREATMENT CENTER”.
B. Notwithstanding anything to the contrary contained in this Lease, Tenant covenants and agrees that Tenant will not use the Demised Premises or any part thereof or permit the Demised Premises or any part thereof to be used:
(a) for retail banking, trust company or safe deposit business:
(b) as or by a retail commercial or savings bank, as or by a trust company, as or by a savings and loan association, as or by a loan company or as or by a credit union;
(c) for the sale of traveler’s checks and/or foreign exchange;
(d) as a restaurant and or bar, and/or for the sale of soda and/or beverages and/or food or sandwiches and or ice cream and/or baked goods;
(e) as a diagnostic medical center and/or for the practice of medicine or health services;
(f) as a school of any kind including but not limited to the teaching of or instructions or giving courses in either secretarial skills, and/or languages and/or the operation of office equipment and/or business machines;
(g) for telephone answering, messenger, photocopying, express mail services for other than Tenant;
(h) as an employment, placement or recruiting agency or similar activity.
Restrictions on Usage. Customer shall not allow any party, other than CentralSquare, to add, update, or delete database records or file system objects directly to or on the server or database except as provided for in the CentralSquare Documentation. Customer shall not access any Server Hardware except as provided in the CentralSquare Documentation or cause any software except the Software provided under this Agreement to be installed on or executed on the Server Hardware.
Restrictions on Usage. The KBO Service may be subject to certain transaction, usage, and other limits, as Bank may prescribe at any time, including, without limitation, certain per transaction, daily limits, and limits on Account access, all of which transaction, usage, and other limits are applied by Bank on the basis of each Customer Profile, except as otherwise expressly provided in this Agreement, any Account Documentation, or any other Application Agreement. All Bank-prescribed transaction, usage, and other limits are for the exclusive benefit of Bank in administering the KBO Service. Bank shall have no duty to Company to enforce any such Bank-prescribed limits. Bank may waive or elect not to enforce any such limits at any time and from time to time without prejudice to Bank's right at any time to elect to enforce any such limits. Within any Bank-prescribed per transaction, usage, or other limits, and subject to the KBO Service features being revised to include a Company-defined limits feature, Bank may at any time permit any Administrator of any Customer Profile to establish any Company-defined per transaction, usage, or other limits for such Customer Profile; provided, however, that such Company-defined per transaction, usage, or other limits are subject to being reduced to not exceed any revised Bank-defined per transaction, usage, or other limits that may be established for that Customer Profile by Bank.

Customer shall not allow any party, other than Xxxxxxxx, to add, update, or delete database records or file system objects directly to or on the server or database except as provided for in the Xxxxxxxx Documentation. Customer shall not access any Server Hardware except as provided in the Xxxxxxxx Documentation or cause any software except the Software provided under this Agreement to be installed on or executed on the Server Hardware.
Restrictions on Usage. The Customer shall not allow any party, other than Xxxxxxxx, to perform “write” operations directly to or on the server or database (such as by using an ODBC driver). The Customer shall not access through direct logon any Server Hardware or cause any software except the Software provided under this Agreement to be installed on or executed on the Server Hardware.
Restrictions on Usage. The Customer will not decompile, or create by reverse engineering or otherwise, the source codes from the object code for the GUARDIAN RFID Software provided under this Agreement, adapt the GUARDIAN RFID Software in any way, or use it to create a derivative work. GUARDIAN RFID will not be responsible in any way for performance of the GUARDIAN RFID Software if the GUARDIAN RFID has been modified, except as modified by GUARDIAN RFID.
Restrictions on Usage. The Customer will not decompile, or create by reverse engineering or otherwise, the source codes from the object code for any Third-Party Software provided under this Agreement, adapt the Third-Party Software in any way, or use it to create a derivative work.
Restrictions on Usage. (i) GUARDIAN RFID reserves the right, in its sole discretion, to limit the Customer’s and any Authorized Customer Personnel’s use of GUARDIAN RFID OnDemand if GUARDIAN RFID determines that the Customer’s or any Authorized Customer Personnel’s use is inconsistent with this Agreement.
(ii) The Customer and any Authorized Customer Personnel may not use GUARDIAN RFID OnDemand for any purpose that is unlawful or that is prohibited by the terms of this Agreement. The Customer and any Authorized Customer Personnel may not attempt to gain unauthorized access to any part of GUARDIAN RFID OnDemand, other accounts, computer systems, or networks connected to any part of GUARDIAN RFID OnDemand through hacking, password mining, or any other means, or obtain or attempt to obtain any materials or information through any means not intentionally made available through GUARDIAN RFID OnDemand.
(iii) The Customer will not (A) copy, reproduce, alter, modify, transmit, perform, create derivative works of, publish, sub-license, distribute, or circulate GUARDIAN RFID OnDemand; (B) disassemble, decompile, or reverse engineer the software used to provide GUARDIAN RFID OnDemand, or copy or catalog any materials or information made available through GUARDIAN RFID OnDemand other than as permitted under this Agreement; or (C) take any actions, whether intentional or unintentional, that may circumvent, disable, damage, or impair GUARDIAN RFID OnDemand’s control or security systems, or allow or assist a third party to do so.
(iv) The Customer will not, and will not allow any party other than GUARDIAN RFID to, perform “write” operations directly to or on the GUARDIAN RFID OnDemand server or database, such as by using an open database connectivity driver, without the prior written consent of GUARDIAN RFID.
Restrictions on Usage. AstraZeneca shall use the MAP Name solely as permitted in this Section 12.5. AstraZeneca shall take reasonable care to conduct the commercialization activities with respect to the Licensed Product in such a manner so as to reasonably minimize endangering, impairing or destroying in any material respect the validity or strength of the MAP Name. As between the Parties, MAP shall retain all right, title and interest in and to the MAP Name. AstraZeneca shall not seek to register or otherwise claim ownership rights in or to the MAP Name. If AstraZeneca or any of its Affiliates challenges or, directly or indirectly, asserts any right, title or interest in or to the MAP Name (other than any right or license granted to AstraZeneca and its Affiliates hereunder), or any registrations or applications for registration thereof, or seeks to register any Trademark confusingly similar thereto in any country for any goods and services, then MAP shall have the right to give written notice to AstraZeneca of such conduct, and AstraZeneca shall immediately cease such conduct.
Restrictions on Usage. Both Parties shall have unrestricted use of the services and network provided hereunder so long as the use of the services and network is consistent with the governing Federal, State and local laws and the terms of this MOU or would otherwise harm the Parties organizational goals.
