RETESTING PROVISIONS. An employee is permitted two attempts to pass the Clerical or Meter Reader Test Battery. An employee who fails to attain a passing score on the first attempt may take the tests a second time 90 days or later following the date of the first testing. Any failure on a Clerical Preemployment Test before July 1, 1986 will not be counted as an attempt.

RETESTING PROVISIONS. An employee is permitted additional attempts to pass the Clerical or Meter Reader Test Battery. An employee who fails to attain a passing score on the first attempt may re-take the tests after the waiting periods below. • Three months between the first and second attempts. • Six months between the second and third attempts. • Twelve months between the third and fourth attempts. • Twelve months for all attempts subsequent to the fourth attempt. In accordance with LA 05-04, the retesting provisions will be relaxed for employees who are on official notice of a return-to-work event (e.g., the LTD return-to-work provisions in Sections 2.24 and 2.19 of the LTD Plan or an internal job search) and for employees subject to demotion and/or displacement during the period of notice.

  • REPORTING PROVISIONS Any failure to comply with reporting provisions of the policies shall not affect coverage provided in relation to this request.

  • Forecasting Requirements for Trunk Provisioning Within ninety (90) days of executing this Agreement, Reconex shall provide Verizon a two (2) year traffic forecast. This initial forecast will provide the amount of traffic to be delivered to and from Verizon over each of the Local Interconnection Trunk groups over the next eight (8) quarters. The forecast shall be updated and provided to Verizon on an as-needed basis but no less frequently than semiannually. All forecasts shall comply with the Verizon CLEC Interconnection Trunking Forecast Guide and shall include, at a minimum, Access Carrier Terminal Location (“ACTL”), traffic type (Local Traffic/Toll Traffic, Operator Services, 911, etc.), code (identifies trunk group), A location/Z location (CLLI codes for Reconex-IPs and Verizon-IPs), interface type (e.g., DS1), and trunks in service each year (cumulative).

  • CLOSING PROVISIONS (a) Subscriber agrees to be identified as a customer of JetBrains and agrees that JetBrains may refer to Subscriber by name, trade name and trademark, if applicable, and may briefly describe Subscriber’s business in JetBrains marketing materials, on JetBrains Site, and in public or legal documents. Subscriber hereby grants JetBrains a worldwide, non-exclusive, royalty-free license to use Subscriber’s name and any of Subscriber’s trade names and trademarks solely pursuant to this marketing section.

  • Governing Provisions This Agreement is made under and subject to the provisions of the Plan, and all of the provisions of the Plan are also provisions of this Agreement. If there is a difference or conflict between the provisions of this Agreement and the provisions of the Plan, the provisions of the Plan will govern. By signing this Agreement, the Grantee confirms that he or she has received a copy of the Plan.

  • Hours of Work and Scheduling Provisions (b) In the event an Employee is scheduled to work on the evening or night Shift(s) on the day(s) or the night Shift commencing on the day(s) on which the Employee is called as a juror or witness in matters arising out of the Employee’s employment with the Employer, the Employee shall be granted a leave of absence for those scheduled Shift(s).
