RETURN OF UNITS. Upon expiration of the Lease Term (as defined in the Appendix) of each Unit, or if Lessor rightfully demands possession of any Unit pursuant to this Lease or otherwise, Lessee, at its expense, shall forthwith deliver possession of the Unit to Lessor, together with its manuals and maintenance records, in the condition required by Section 4 and any additional return requirements specified in the relevant Appendix by preparing and appropriately protecting the Unit for shipment and, at the option of Lessor, surrendering it to Lessor at a location in the Continental United States selected by Lessor in such condition that the Unit could be installed without delay and operate at manufacturer's recommended specifications and production capacity, all at Lessee's expense. Lessee shall safely store, insure and maintain the equipment for an additional 60 days after the expiration of the Lease Term of each Unit.

RETURN OF UNITS. If Lessor rightfully demands possession of any Unit pursuant to this Lease or otherwise, Lessee, at its expense, shall forthwith deliver possession of the Unit to Lessor, at the option of Lessor (a) by delivering the Unit, appropriately protected and in the condition required by Section 4, to Lessor at such place as may be specified by Lessor within the county in which the Unit was originally delivered or, if the Unit has been moved to another county in accordance with this Lease, within such other county, (b) by loading the Unit, appropriately protected and in the condition required by Section 4, on board such carrier as Lessor shall specify and shipping the same, freight collect, to the destination designated by Lessor, or (c) by surrendering possession of such Unit in the location set forth in the Schedule for such Unit and providing the Support Rights described in Paragraph M of the Appendix.
RETURN OF UNITS. Upon any termination or expiration of the lease term with respect to any Unit, subject to any Lessee purchase of the Unit pursuant to the applicable Schedule, Lessee shall, at its own expense, prepare and adequately protect the Unit for shipment and either surrender it to Lessor in place or, if instructed by Lessor, ship the Unit to Lessor, freight and insurance pre-paid, at a place reasonably designated by Lessor, in the condition required under Section 4 hereof and under the applicable Schedule, and able to be put into immediate service and to perform at manufacturer's rated levels (if any), together with all related manuals, documents and records. If Lessee does not so surrender or return a Unit to Lessor, in addition to all other rights and remedies available, at Lessor's election, such Unit shall continue to be subject to all the terms and conditions of the Lease, with rent and other charges continuing to accrue and be payable under the Lease with respect to such Unit until it is so surrendered or returned to Lessor, except that Base Rent shall accrue, payable on demand, at the rate of 150% of the rate applicable in the last period for which Base Rent was payable.
RETURN OF UNITS. Upon expiration of the terms of this Lease with respect to each Unit, or if Lessor shall rightfully demand possession of such Unit, Lessee, at its expense, shall forthwith deliver possession of such Unit to Lessor, appropriately protected and in the condition required by Section 4 hereof, at the option of Lessor, (a) to the premises of nearest Xxxxxx Machinery store selling equipment of the same type as such Unit, or (b) on board such carrier as Lessor shall specify and shipping the same, freight collect, to the destination designated by Lessor.

If Owner Trustee shall rightfully demand possession of any Unit pursuant to this Lease or otherwise, Lessee, at its expense, shall forthwith (i) deliver possession of such Unit to Owner Trustee by delivering whatever data, information, records, reports, software, and other property is necessary to own and operate the Unit, all of which shall be in proper working order, to Owner Trustee, (ii) at the request of Owner Trustee, take all actions within Lessee's power to cause to be transferred to the Owner Trustee all Permits and other rights and privileges necessary to use the Units and (iii) take the actions specified on Annex III to Schedule II hereto.
RETURN OF UNITS. If Lessor rightfully demands possession of any Unit pursuant to this Lease or otherwise, Lessee, at its expense, shall forthwith deliver possession of the Unit to Lessor, in the condition required by Section 4 and any additional return requirements specified in the relevant Appendix, by preparing for shipment and, at the option of Lessor, (a) surrendering it to Lessor at its location or base specified in the relevant Appendix or (b) loading the Unit on board such carrier as Lessor shall specify and shipping the same, freight collect, to Lessor at the place designated by Lessor in the state where the Unit was located or based pursuant to the relevant Appendix.
RETURN OF UNITS. At the expiration of this Lease, or at the direction of Lessor pursuant to Section 14 of this Lease, Lessee shall at its own cost, expense and risk, deliver possession of the Units to Lessor at the Spring Creek Mine in Xxxxxx Montana. Each Unit returned to the Lessor pursuant to this Section 15 shall: (i) be empty, free from debris, lading, residue of lading, suitable for loading, and in the same or better operating order, repair and condition as when originally delivered to the Lessee, reasonable wear and tear excepted; (ii) meet the standards then in effect under the Interchange Rules of the Association of American Railroads, the Surface Transportation Board, the Department of Transportation, and any other legislative, administrative, judicial, regulatory or governmental body having jurisdiction in the matter; and (iii) be free from any damage due to the abuse of the Unit as specified in Section 4(c). If any Unit is not delivered to Lessor on or before the Expiration Date, or is so delivered, but not in compliance with this Section 15, each and every Unit shall remain subject to the terms and provisions of this Lease until the Unit or Units are returned to Lessor or until any non-compliance with this Section 15 is resolved. Nothing in this Section 15 shall be construed as Lessor’s authorization of the Lessee’s use of the Units, or any Unit, after the Expiration Date. Lessee’s obligations in this Section 15 shall survive the Expiration Date of this Lease.

If Lessee does not so surrender or return a Unit to Lessor, in addition to all other rights and remedies available, at Lessor’s election, such Unit shall continue to be subject to all the terms and conditions of the Lease, with rent and other charges continuing to accrue and be payable under the Lease with respect to such Unit until it is so surrendered or returned to Lessor, except that Base Rent shall accrue, payable on demand, at the rate of 150% of the rate applicable in the last period for which Base Rent was payable.
RETURN OF UNITS. Within 14 days from the expiration or termination of the term of this Lease, the Expiration Date, or if Lessor shall rightfully demand possession of a Unit, Lessee, at its expense, shall promptly deliver possession of the Unit(s) to Lessor, properly protected and in the condition required by this Lease and the unit specifications, on board a carrier named by Lessor and shipping it, freight collect, to the destination designated by Lessor. If the Unit is not in the condition required, Lessee shall pay to Lessor all costs and expenses incurred by Lessor to bring the Unit into the required condition, the amount of which shall be outlined in an invoice from Lessor and shall be due within 30 days from the date of such invoice.
RETURN OF UNITS. Upon the expiration of this Agreement for any Unit, Lessee shall return, at Lessor's sole expense, such Units to Lessor at the place as Lessor may direct. Each Unit shall be returned by Lessee in good working condition subject to normal wear and tear.
