Review of Workplace Decisions. 66.1 Where concerns arise over decisions or actions affecting an employee covered under this Agreement, a request for review of the decision or action may be lodged. For more information on review of decisions or actions employees should refer to HRP 3 Review of Actions.

Review of Workplace Decisions. 264 An employee is entitled to request a review of any decision/action that relates to their employment or working arrangements. At any point in this process the employee may, where they so choose, be supported by a person of their choice. 265 An employee may exercise their rights of review under section 33 of the Public Service Act 1999 and Part 5 of the Public Service Regulations 1999 at any time, noting that not all actions are reviewable. 266 Where an employee wishes to pursue a review the following framework applies (subject to clause 265). Preliminary review 267 An employee will discuss matters affecting them with their immediate manager. Where this action would be inappropriate the employee will discuss the issue with the relevant General Manager. Where the employee is not satisfied with the outcome of the Preliminary review the following will apply. Primary review 268 An application must be made in writing to the Secretary, who will consider whether the primary review should be undertaken within the Department or referred to the Merit Protection Commissioner, in accordance with Regulation 5.25 of the Public Service Regulations 1999. 269 Where a review has been requested the Secretary may, where appropriate, seek to resolve the matter through mediation using an independent person agreed by both parties prior to the commencement of the review. 270 If mediation is unsuccessful or not appropriate the Secretary will:
