Rights of short-term employees to regular positions. Should an opening for a regular appointment position become available, it will be filled through open competition, unless the regular position consists of the assignments already being satisfactorily performed by a short-term employee who has the required expertise as defined in Article 1.8 and who is either eligible for regularization in accordance with Article 4.2.2 or who has filled the position on a replacement basis for a period of two (2) years. Notwithstanding the above paragraph, a short-term employee who is hired in emergency circumstances, with less than the normally required qualifications or expertise, will have no right to further appointments of work of a similar nature, pursuant to Article 4.2 of this agreement. In such cases, a notation to that effect will be included in the employee’s contract.
