Room and Board Conditions. The following room and board conditions shall apply to all employees with the exception of local residents as defined in (b) herein: (a) On jobs where camps are provided, room and board will be supplied in camp at no cost to the employee. Camp accommodations, when supplied, shall meet all the standards and requirements of the BC Construction Camp Rules and Regulations, 2008 - 2014 (By and Between BCYT-BCTC and CLR) as submitted to the Association and attached hereto. Any employee may refuse to live in accommodations which do not meet the above standards. (b) On jobs where camps are not provided, employees who are not local residents where the work is being performed shall receive either (i) an acceptable standard of room and board supplied and paid for by the Employer based on reasonable receipts provided or rane Rental Agreement May 1, 2019 to April 30, 2023 (ii) an acceptable standard of room and a meal allowance based on sixty-five dollars ($65.00) (effective May 1, 2020 sixty-seven dollars and fifty cents ($67.50), and effective May 1, 2022 seventy dollars ($70.00)) per day. A local resident shall be defined as an employee who has resided at a permanent address within eighty (80) kilometers by road of the project, or where ferry travel is involved, within seventy-five (75) minutes travel time including ferry travel and road kilometers.

(iii) Living-out Allowance (LOA) on the basis of seven (7) days per week (excluding any periodic leaves) at one-hundred-and-seventy-five dollars ($175.00) per calendar day and will be paid on the employee’s regular pay day. Effective May 1, 2024 one-hundred-and-eighty-five dollars ($185.00) per calendar day. Effective May 1, 2025 one-hundred-and- ninety-five dollars ($195.00) per calendar day.

  • Weather Conditions The Contractor will be required to protect all work and materials against damage or injury from the weather. If, in the opinion of the County, any work or materials shall have been damaged or injured by reason of failure to protect such, all such materials or work shall be removed and replaced at the expense of the Contractor.

  • SETTLEMENT TERMS AND CONDITIONS Without admitting or denying the Department’s findings, Associated is willing to resolve the violations cited herein and in the visitation report by entering into this Agreement and freely and voluntarily waives its right to a hearing under Banking Law Sections 44 and 598 on such violations. Therefore, in consideration of the promises and covenants set forth herein: 1. Associated agrees to take all necessary steps to ensure its compliance with all applicable federal and state laws, regulations, and supervisory requirements relating to its mortgage business, including, but not limited to: a. complying with the requirements of Article 12-D and Article 12-E of the Banking Law, Section 420 of the Superintendent’s Regulations, and Part 38 of the General Regulations; and b. ensuring that its MLOs who conduct mortgage origination activities are licensed pursuant to Article 12-E of the Banking Law and Section 420 of the Superintendent’s Regulations; c. ensuring that its MLOs do not mislead consumers as to their license status; and d. ensuring that its MLOs do not share their unique identifier with any other individual or entity; and e. ensuring that its non-MLO staff does not engage in mortgage activities that require a license; and f. ensuring that its non-MLO staff does not have access to any mortgage loan origination system, software, and documents, and they do not utilize a MLOs unique identifier; and g. ensuring that its books and records, specifically the application logs, are in compliance with Section 410.7 of the Superintendent’s Regulation. 2. Associated agrees to continue to further develop appropriate written compliance policies and procedures designed to ensure compliance with all applicable federal and state laws, regulations, supervisory requirements and guidance letters. The policies and procedures shall, at a minimum: (i) designate an individual responsible for monitoring compliance with all applicable federal and state laws, regulations, supervisory requirements and guidance letters; and (ii) establish a training program to ensure that Associated and its MLO and non-MLO employees understand all applicable federal and state laws, regulations, supervisory requirements and guidance letters. 3. Within ninety (90) days from the effective date of this Agreement, Associated agrees to submit a draft of its compliance policies and procedures to the Department. 4. Within one hundred twenty (120) days from the effective date of this Agreement, Associated agrees to submit a copy of its final compliance policies and procedures to the Department together with a letter from an authorized officer of Associated indicating his/her approval of such policies and procedures. 5. Associated agrees to pay a fine of $ $25,000 payable in two (2) equal installments as follows: $12,500 upon execution of this Agreement $12,500 within 30 days after the execution of this Agreement. 6. Associated further agrees that such payment will be made in immediately available funds in accordance with the Department’s payment instructions.

  • Safe Working Conditions The Employer undertakes to maintain office furniture, equipment, etc., in a practical and safe condition in order to avoid injury to employees or damage to their attire. Employees, for their part and in their own interest, are expected to advise the Employer of any such potentially injurious equipment.

  • SUPERIOR CONDITIONS 21.01 All existing benefits, rights, privileges, practices, terms or conditions of employment which may be considered to be superior to those contained herein and which are set out in Appendix 4 are specifically retained by this Agreement unless otherwise agreed by the local parties. The parties agree to remove from Appendix 4 those superior conditions which no longer have application. Where the parties cannot agree on whether a superior condition continues to have application, the issue will be reduced to a grievance and referred to arbitration. 21.02 The Union and the Participating Hospitals agree to establish a committee consisting of two (2) representatives of the Union and two (2) representatives of the Participating Hospitals to review the superior conditions appendices in each of the participating hospitals. This committee will report to their respective negotiating committees prior to the next round of central negotiations.

  • Unsafe Work Conditions No Employee shall be disciplined for refusal to work on a job which in the opinion of: (a) A member of a safety committee; or (b) A person designated by a safety committee; or (c) A safety officer after an on-site inspection and following discussion with a representative of the Employer, does not meet the standards established pursuant to the Workers' Compensation Act.
