Scope of insurance. (a) Prior to the commencement of construction work at the Site, the Feed-in Approval Holder shall insure and maintain in effect throughout the execution of construction works of the Renewable Energy Installation, Interconnection Facilities and Communication Facilities an insurance coverage against any damage, malicious damage, loss or injury which may occur to any property (including that of the Distribution Licensee) or to any person (including any employee of the Distribution Licensee) by or arising out of and/or in carrying out construction, operation and maintenance activities relating to the Renewable Energy Installation, Interconnection Facilities and Communication Facilities. (i) Each Party (the “Indemnifying Party”) shall indemnify the other Party (the “Indemnified Party”) in respect of any damage, compensation or injury occurring to any person or to property and against all actions, claims, suits, demands, costs, charges and expenses arising and in connection therewith which shall be occasioned by the negligence of or breach of statutory duty by the Indemnifying Party (and/or any subcontractor of the Indemnifying Party), or by defective design, materials or workmanship, but not otherwise, or by the operation of the Workmen’s Compensation Ordinance 1952, and/or the Employees Social Security Act 1969, and/or any statutory modification or re-enactment thereof for the time being in force, but not otherwise. (ii) The Indemnifying Party shall insure against such liability and maintain in effect such insurance during the whole of the time that any persons are employed at the Site and/or Renewable Energy Installation and/or Interconnection Facilities.
Scope of insuranceArticle 2 (1) On taking up their appointment with the UNIDO or after the completion of three years of continuous service with the UNIDO, officials shall have the right in accordance with the provisions of Article 4 to participate in any of the branches of the social insurance provided for in the ASVG and in the unemployment insurance provided for in the AlVG. (2) The insurance under paragraph (1) shall have the same legal effect in each of the selected branches as compulsory insurance. (1) Insurance under Article 2 (1) shall take effect on the day on which the official takes up his/her appointment with the UNIDO, if a written declaration to participate is made within seven days of taking up the appointment, otherwise on the day following the date on which the declaration is made. (2) Insurance under Article 2 (1) shall cease on the date on which the official's appointment with the UNIDO terminates. (3) Notwithstanding the provisions of paragraph (2), insurance under Article 2 (1) shall cease as of the effective date of an official's assignment to duty outside Austria for a period of more than three months, unless the insurance is maintained by submission of a written declaration. (4) In the case of termination of the insurance under paragraph (3), the former insurance may be resumed with the same scope of coverage upon completion of the official's assignment according to the terms of paragraph (1). (5) On becoming participants in the Pension Fund or after the completion of three years of continuous service with the UNIDO, officials shall have the right, according to the terms of Article 4, to terminate their insurance in each of the selected branches of the social insurance provided for in the ASVG and in the unemployment insurance provided for in the AlVG.
Scope of insurance. The insurance required hereunder shall name the Owner and the Contractor as named insureds and shall provide protection for the Owner and the Contractor against damage which may arise from operations under this Contract, whether such operations be by the insured or by anyone directly or indirectly employed by him.

The Insurer does not pay the costs of legal representation of the affected party or the Insured. Without the prior written consent of the Insured Event Administrator, the Insured may not take any action by which he/she would admit his/her liability or admit or amicably resolve any claim, including the claim for reimbursement of costs associated with the exercise of a claim under liability for damage.
Scope of insuranceThe Contractor shall obtain prior to the commencement of the Contract, and shall maintain in full force and effect for the term of this contract, at the Contractor's expense, the policies indicated below in subsection D for the protection of the Contractor. The Contractor shall not undertake any acts that shall affect the coverage afforded by the above policy. If the insurance policy is issued on a “claims made” basis, then the Contractor shall continue to obtain and maintain coverage for not less than three years following the completion of the contract.
