Section 13.5.1. 10 District officials will not be present during the Union’s presentation.
Section 13.5.1. 11 If the District determines that seniority rights should not govern because a junior employee 12 possesses ability and performance substantially greater than a senior employee(s), the District 13 shall set forth in writing to the employee(s), who applied for the position its reasons why the 14 senior employee(s) was (were) bypassed.
Section 13.5.1. 41 All bumping to avoid layoff is subject to the seniority bypass provisions of Section 13.5. above. 42 The Minimal Displacement Bumping Process will be as follows:

Section 13.5.1. 30 All vacancies and new positions shall be publicized to the staff and the Association through a 31 written notice which shall be distributed to each classified building secretary or department 32 supervisor and forwarded to the President of the Association as far in advance of the date of the 33 opening of any vacancy or new position as possible. The position will be posted to in-District 34 employees for five (5) workdays, with an additional five (5) days to be allowed for 35 interviewing and/or testing, if required before it is opened to the public. The job posting shall 36 give information about the position regarding building, hours of job, duties required, etc. 37 Employees in any classification shall have preferential rights over “out-of-District applicants”. 38 Employees applying for open or posted positions outside of their classification shall have 39 preferential rights over out-of-District applicants pursuant to Section 13.5. 40
Section 13.5.1 qualified employee who makes application to fill a vacancy in another classification shall 8 have preferential seniority rights over any applicant outside the bargaining unit who applies for 9 the vacancy. 11 If the District determines that seniority rights should not govern because a junior employee 12 possesses ability and performance substantially greater than a senior employee or senior 13 employees, the District shall set forth in writing to the employee or employees and the 14 organization's president its reasons why the senior employee or employees have been bypassed.
