Section 13.5. 34 If the district determines that seniority rights should not govern because a junior employee possesses ability 35 and performance substantially greater than a senior employee, the District shall set forth in writing to the 36 employee and the association president its reasons why the senior employee has been bypassed.
Section 13.5. 13 The District will notify the Association of all new hires governed under this agreement within ten (10) 14 working days of the hire date. At the time of hire, the District will inform the new hire of the terms and 15 conditions of this Article.
Section 13.5. 2 Representatives of the Association may be granted time with compensation to attend workshops or 3 seminars when the request is approved by the District.
Section 13.5. District shall provide tort liability coverage for all employees subject to this Agreement, if the 3 employee is operating in the lawful and good faith performance of their duties.
Section 13.5. 45 Termination of probationary employees as defined in this Agreement for any reason is not subject to the 46 grievance procedure.
Section 13.5. District will notify the Union of all new hires within ten (10) working days of the hire date.
Section 13.5. 27 Employees who have been given the job assignment which requires them to assist with toileting 28 and/or work with volatile/potentially aggressive students shall be paid the differential one dollar 29 per hour for all hours worked in such assignment. These employees will be assigned at the 30 discretion of the Superintendent along with the Special Education Director. 31 33 34 ARTICLE XIV 35 36 TERM AND SEPARABILITY OF PROVISIONS 37 38 Section 14.1. 39 This agreement shall be effective September 1, 2021 to August 31, 2024. 41 Section 14.2. 42 This agreement may be reopened and modified at any time during its term upon mutual consent of the 43 parties in writing; incremental steps on Schedule A shall be funded by the District. Schedule A will be 44 increased by 4% or State authorized and funded IPD, whichever is greater, for the 2022-2023 contract 45 year. Schedule A will be increased by 4% or State authorized and funded IPD, whichever is greater, for 46 the 2023-2024 contract year.
Section 13.5. 27 The District shall make every effort to provide training to paraeducators prior to any new curriculum 28 adoption by the District.
