Selective Tendering. Where a procuring entity intends to use selective tendering, the entity shall:

Entities that intend to use selective tendering shall in the notice of intended procurement or in the notice inviting suppliers to submit a request for participation invite qualified suppliers to submit a request for participation and indicate the time- limit for submitting requests for participation.
2. When using selective tendering procedures, a procuring entity shall recognize as qualified suppliers such domestic suppliers and suppliers of another Party that meet the conditions for participation in a particular procurement, unless the procuring entity states in the notice or, where publicly available, in the tender documentation, any limitation on the number of suppliers that will be permitted to tender and the objective criteria for such limitation. Procuring entities shall select the suppliers to participate in the selective tendering procedure in a fair and non-discriminatory manner.
3. Where the tender documentation is not made publicly available from the date of publication of the notice referred to in paragraph 1, procuring entities shall ensure that the tender documentation is made available at the same time to all the qualified suppliers selected in accordance with paragraph 2.
4. Entities maintaining permanent lists of qualified suppliers may select suppliers to be invited to tender from among those listed, under the conditions foreseen in Article

In selective tendering, entities may limit the number of qualified suppliers they will invite to tender, consistent with the efficient operation of the procurement process, provided that they select the maximum number of domestic suppliers and suppliers of another Party, and that they make the selection in a fair and non-discriminatory manner and on the basis of the criteria indicated in the notice of intended procurement or in tender documents.
2. Entities maintaining permanent lists of qualified suppliers may select suppliers to be invited to tender from among those listed, under the conditions foreseen in Article 57(7). Any selection shall allow for equitable opportunities for suppliers on the lists.

Selective Tendering. 1. To ensure optimum effective competition under selective tendering procedures, procuring entities shall, for each intended procurement, invite tenders from the maximum number of domestic suppliers and suppliers of the other Party, taking due account of the efficient operation of the procurement system and market conditions. They shall select the suppliers to participate in the procedure in a fair and non-discriminatory manner.
2. For greater certainty, a procuring entity applying selective tendering may use a list of qualified suppliers or a multi-use list established in accordance with Article 17.9.
Selective Tendering. 13.1. In order to ensure optimum and effective international competition in selective tenderings, entities shall invite to participate, for each procurement, the greatest possible number of domestic suppliers and suppliers from other Parties as are compatible with the efficient working of the procurement system. The entities shall select, in a fair and non-discriminatory manner, the suppliers who may participate in the tendering.
13.2. Entities that keep permanent lists of qualified suppliers may select those suppliers that will be invited to participate from among those included in such lists. Every selection must afford equal opportunities to the suppliers included in the lists.
13.3. Suppliers who apply to participate in a specific procurement shall be permitted to present offers and will be taken into account with the proviso that those who have not yet been qualified, be afforded sufficient time to complete the qualification procedure as provided for in the Article 20 (Qualification of Suppliers). The number of additional suppliers authorized to participate shall be limited only for reasons related to the efficient functioning of the procurement operation.
13.4. Applications to participate in selective tenderings may be submitted by telex, telegram or fax.
13.5. Where an entity of a Party does not invite or accept a supplier to tender, at the request of the supplier, the entity shall provide without delay any pertinent information on the reasons for its action.]
