SENIORITY - PROBATIONARY EMPLOYEES. A. An employee's seniority within the bargaining unit shall be a composite of the following periods of time: 1. An employee’s present continuous period of employment in date of rank with their current contract period (either a one-hundred and eighty-nine (189) or a two hundred and fifty six (256)-day contract) is for bidding purposes only. In the case where there is more than one employee with the same date of rank, seniority will be determined by the most recent date and time stamp maintained by Human Resources 2. In the event an employee is moved due to injury, hardship, or other extenuating circumstances (agreed upon by the Chief of Police and the Union), the employee’s previous seniority will be reinstated according to time of service with the district. 3. layoff periods in job title which did not exceed twelve (12) months in duration: 4. all periods of leaves of absence which have been approved by the District. B. An employee shall be considered probationary for the first twelve (12) months of employment in job title. During these probationary periods, any employee on probation may be terminated with such termination not subject to the grievance procedure. Employees may submit a written request to the Superintendent for the reasons for termination within five (5) days from the date the termination notice is served. The Superintendent or administrator shall provide written reason(s) for the decision to terminate within ten (10) working days of the request. The reasons shall not be publicly disclosed by the superintendent, administrator, local school board or governing authority. The reasons shall not provide a basis for contesting the decision under the School Personnel Act [22-10A-1 NMSA 1978]. The employee may be accompanied by an Association Representative.
