Common use of Separation Allowance Clause in Contracts

Separation Allowance. (a) Where an employee resigns within thirty (30) days after receiving notice of layoff pursuant to Article 14.01(b) that her position will be eliminated, she shall be entitled to a separation allowance of one (1) week’s salary for each year of continuous service to a maximum of twenty-six (26) weeks pay plus a pro- rated amount for any additional partial year of service, on the basis of the employee's normal weekly earnings. If the employee is terminated prior to the end of the minimum notice period, she shall receive the balance of the notice as severance pay.
